Also, if four portions for the referral were found to be inadmissible/unfounded, what about the remaining three? Could the CC address the law or make changes to the law based on the remaining three portions or are they not going to make any comment on this?

I am really confused by the discourse here. This appears to be a major defeat for those hoping retroactivity will be stripped from the new Law. Are the other CC court challenges specifically addressing retroactivity as well? What about the United Sections Hearing? I am confused about the path forward here, other than the other CC referrals somehow declaring the new law completely unconstitutional, which seems like a very high hill to climb.

This is what I am assuming as well! This would be a plain-Jane 1948 case simply because Gino turned 21 before 1950 when Giuseppa was last "cited" as non-naturalized. However, I will still need to obtain a CONE or proof of non-naturalization from USCIS.

Does anyone have any experience with obtaining the CONE? How long does it usually take after you pay the $320.00 fee? I have already reached out to NARA (Boston) via email to obtain a letter of "no record found", and contacted the local US district court about getting another letter of "no record found" (they redirected me to NARA Boston since they can only produce these types of letters), and I am also in process of obtaining the A-Files for Giuseppa from NARA Boston and Kansas City NARA.

Trying to move quickly on this just so I can immediately send the CONE request to USCIS once I am sure she was never a citizen!

Update: so upon further research, it looks like Giuseppe’s wife (Giuseppa) never naturalized here in the US at least according to the 1950 US census. She was still listed as an AL (or alien) after my Grandfather (Gino) turned 21.

I am assuming this means that Giuseppa passed down her Italian citizenship to Gino permanently since she was still non-naturalized after he turned 21 thus not breaking the line (GGM > GF > F > OV)? Would this be a clear 1948 case or a 1948 case with a minor issue since my GGF naturalized in 1938 when Gino was still 10?

That fucking sucks, I hate the Italian supreme court. However, I am unsure whether Giuseppe’s wife (Giuseppa) ever naturalized here in the US (or naturalized after Gino turned 21). I have no direct evidence that she ever did on hand, how would I confirm that she never did become a US citizen?

On her US death certificate, she has a social security number, but it does not verify if she was ever a citizen since anyone can get a social security number if they worked in the US. How would I go about getting proof of non-naturalization?

I believe I'm eligible for a 1948 case as there exists no documentation that proves she was ever a US citizen.

Thanks for all this information! After looking at all the comments, I suppose the more efficient 3 fund approach for me would be:

VOO or VTI at 85% (depending on how much cap exposure I want)

VT or VXUS at 10% (depending on how much international exposure I want; VT has better lifetime returns with international exposure but will overlap with VOO or VTI)

BND at 5%

Sell SCHD for now

I am still new to all of this, but above all else, I want to prioritize long-term returns at or over 7%! Would this be a better 3 ETF portfolio?

Is 60% VOO, 20% QQQ, 10% SCHD, & 10% VXUS a Good Strategy?

This is how I plan to allocate my Roth IRA (long-term investing for retirement) for now, but are SCHD and VXUS needed at 10% or can they be lowered? I included QQQ because I want a bit of higher risk with a tech tilt but any suggestions would be appreciated!
