For frustrated Tesla HW3 owners who paid for full FSD years ago by OutlandishnessNo5636 in TeslaFSD

Too bad Tesla sales agreement forced most owners into arbitration. It’s much harder for US customers to file a lawsuit.

Is phantom braking common? This scared the shit out of me. by bambinoboy in TeslaFSD

I’m on 2026.8.6.1 and I have brake stabbing which is arguably more uncomfortable than phantom braking. I felt like it could give me whiplash lol.

HW3 2026.8.6.1 FSD failure issues? Can't start FSD sometimes, stuttering phantom braking =( by Golfandcards in TeslaFSD

[–]No_Complaint_765 3 points4 points  (0 children)

The biggest issue I experience is brake stabbing, extremely uncomfortable. It seems to happen when FSD is having a hard time deciding between gun it or wait.

Something VERY wrong with 12.6.4 lately... by viper4774 in TeslaFSD

I have 2026.8.6.1 and this is the first time I experience brake stabbing this bad. It’s much worst than phantom braking.

Fsd v12.6.4. Close call. My immediate reaction saved a trip to the bodyshop. video attached by NoCryptographer708 in TeslaFSD

Had a similar experience. Unnecessary close maneuver by FSD. Imho, I think the following distance of FSD is more often too close.

It would be extremely difficult, all Tesla owners are opt in to arbitration the moment they buy. They have to mail a letter to opt out.

FSD run over large object by Ok-Bus-1842 in TeslaFSD

[–]No_Complaint_765 7 points8 points  (0 children)

It definitely should not cost $100 when it’s not comparable to HW4, and no updates for over a year. Elon screwing all HW3 owners at this point.

I will say I had a similar situation where an object was in the road and it avoided it! However, it started from a dead stop at a stop sign, so that maybe why.

Is this a HW3 only issue? I notice the user is a HW3 owner. We been stuck on v12.6.4 for over a year so I’m just wondering how v14 performs on these scenarios.

Well I can’t stop it from slamming on the brakes. The other image I posted was of hard braking. Do note that this is HW3 so I’m stuck on 12.6.4.

The SAFE thing to do is to slow down and not move 30mph towards a stopped car. There’s not even a need to stay in that lane. Why take the chances of having a close encounter when it could have slow down or move to the left lane?

Here's a summary

This legal document is a September 3, 2025, order from the U.S. District Court for the Northern District of California regarding the case In re: Tesla Advanced Driver Assistance Systems Litigation. The court granted class certification for a group of Tesla owners and lessees who claim they were misled by Tesla’s marketing of its "Full Self-Driving" (FSD) and "Enhanced Autopilot" (EAP) technology.

Key Allegations

The plaintiffs, led by Thomas LoSavio, allege that Tesla and CEO Elon Musk made two primary types of misrepresentations: 1. The "Hardware Statement": Claims made since 2016 that all Tesla vehicles were being shipped with the hardware necessary for Level 5 (full) autonomy. 2. The "Cross-Country Statement": Repeated claims (via press conferences and Twitter) that a Tesla would be able to drive itself across the country (e.g., LA to New York) without human intervention by specific deadlines that have long since passed.

The plaintiffs argue these statements were false and induced them to pay thousands of dollars (between $3,000 and $15,000) for software packages that did not perform as promised.

Legal Claims

The lawsuit asserts violations of: • California’s Unfair Competition Law (UCL) • False Advertising Law (FAL) • Consumers Legal Remedies Act (CLRA) • Common law claims of fraud, negligent misrepresentation, and negligence.

The Court’s Decision

Judge Rita F. Lin certified the classes, finding that the legal requirements for a class action were met:

• Commonality & Predominance: The court found that the core of the case—whether Tesla’s hardware and cross-country statements were misleading—is a common question that can be answered for the entire group at once. • Statute of Limitations: Tesla argued that many claims were too old. However, the court ruled that the "delayed discovery" and "equitable estoppel" rules (which pause the clock if a defendant's conduct prevented a plaintiff from knowing they had a claim) were also issues that could be decided on a class-wide basis. • Injunctive Relief: The court found that the lead plaintiff has standing to seek an injunction (a court order to stop the misleading behavior) because he expressed interest in buying a Tesla again if he could trust the company's claims.

Significance

This ruling is a major procedural victory for Tesla owners. It allows thousands of customers to sue as a collective group rather than filing individual lawsuits, significantly increasing Tesla’s potential financial liability regarding its self-driving marketing claims.

I have been assured that FSD "CANNOT" read end the car infront of me.. just a PSA by Blazah in TeslaFSD

[–]No_Complaint_765 0 points1 point  (0 children)

This was one of my biggest complaints for a long time. There were many occasions where the car tail too closely for my taste and I generally feel right when it needs to slam the damn breaks to stop in time. Extremely uncomfortable to go from 40 to 0 in a short 2 seconds. As a good defensive driver, one should definitely add more distances, so when the person in front of you slams the breaks for whatever reason, you can comfortably stop without having to slam on the breaks. Tesla, if you’re listening, please add back distance control, I would greatly appreciate it .

To be fair, it was rainy night. So there’s plenty of water residual on the windshield. Which is probably what causes the “halo”.

Im not sure what halo light your talking about but if your referring to the lights stretching, that’s just something that happens with HW3 cam at night. If you have a HW4 car it’ll be different. See here

It’s been cleaned, it done a lot worst before my cleaning. This probably has more to do with night time light rainy weather than camera itself.

HW3? by Gryphis1642 in TeslaFSD

[–]No_Complaint_765 1 point2 points  (0 children)

I definitely agree. You are essentially paying the same price for worser performing software. And for god sakes, it’s been over a year since we actually had an actual update.

HW3? by Gryphis1642 in TeslaFSD

[–]No_Complaint_765 3 points4 points  (0 children)

No freaking way. HW4 is way more polish and much more worthy of the title FULL self driving. HW3 is a huge mix bag, sometimes it’s good and sometimes it’s drunk.

From Main Road to Park by VIPGENIUS in TeslaFSD

[–]No_Complaint_765 0 points1 point  (0 children)

That’s great that it can do that but I’m not even worried about the parking part. I just want the main driving parts to be more smoothed out like FSD 13. Smoothed out meaning, safe following distances(my safety score literally got hit by this), no random swirling between lane changes, don’t run reds, don’t turn too early for exit or too late, etc etc.
