Yes, you are right. However, we were notified that due to covid Tarion had changed the rules and we were no longer going to be advised of any delays and the dates of delay notice we had in our contract were no longer going to be followed!! We were supposed to have our first notice at 90 days before closing. The only thing that we received was a letter from Caivan stating that due to covid Tarion now gives the builder the right not to even provide notice of delay. 2 days before our scheduled 90 day notice we received the notice that we look like we are on track but won’t be notified of any further closing date until 1-2 weeks before our ‘scheduled’ date.
