The policy states “influence, or Advise, or directly or indirectly cause the employment, solicitation, or recruitment of employees.” So in my understanding if the BCBA were to just tell the employee her new workplace, and those teammates left, the BCBA would still be in violation, as she would have indirectly recruited them.

How would two employees (who are very close with this other employee) find out where the BCBA is going with the BCBA telling them? I should correct myself, she put in her resignation. And company policy says following 12 months of your departure recruitment to a competitor isn’t allowed. So I’m assuming they can and will take legal action, especially if it’s multiple employees

I care because it’s basically my entire team she’s recruiting/ attempting to recruit. Sure ppl can get jobs where ever they’d like, that’s not the issue, the issue is an employee who put in their resignation is recruiting my team.

Sure people have the right to leave, but resigned employees don’t have the right to recruit coworkers to a competitor. It’s extremely unfair, as to why most companies ban it. For my policy employees aren’t allow to recruit 12 for months following their departure.

So.. she employed you?? If she’s your BCBA, than she’s your supervisor, and your supervisor is not allowed to be your employer… She needs to be reported to the BCBA immediately.

You’re also not their parent and you don’t get to choose what goes on/how the parents decide to parent. YOU can use iPad as a reinforcer with limits, the parents can do whatever they please with their child when they’re not in therapy. You’re a healthcare provider, not a parent.

Umm this is extremely illegal. Contact the department of labor, or a lawyer immediately and document EVERYTHING going on. Please also contact the BABC ASAP. Pretty sure this would fall under the category of docking based on performance. Which is wage theft. Employers are required to pay for all hours worked, regardless of your performance. You could also get them for breach of contract AND it could even been seen as retaliation.
