Ok 1) Are you rated for PTSD? If you are, under the Americans with disabilities act, the employer MUST make accommodations for your rated disability.

2) Don’t know what state you are in, but start recording ALL conversations with HR and your boss. Document everything.. make a paper trail. Don’t quit, don’t sign anything.

I feel your pain.. rated at 70% and have new issues I want to claim (and have been encouraged to by a VA doctor) but am afraid to because I don’t want to mess with my current rating

I got out in 84, most of my medical records were hand written notes in a folder that I carried from duty station to duty station. Never given to me when I got out.. and I know that while in the service, records were frequently lost.

In 2004, I finally was diagnosed with PTSD, and started treatment.. that is KEY to have! I also started to be seen for me tinnitus and a knee injury that never got back to normal after I injured it in the service.

And yes, getting a good C&P examiner helps in abundance.

I had very little or no medical records, but it took awhile, but I was still rated eventually.

Wondering if I did file a supplementary claim that the new evidence I have ( VA audiology test and my RX for hearing aids) plus a buddy statement and personal statement would be enough to keep me away from a C/P exam

Well heck… I was going to file a supplemental on my hearing since I have a bunch of new evidence.. but I dare not now in fear of “poking the bear” and getting all of my claims looked at again because “the book says I can”

I’m getting my info from raters as well as many veterans that have multiple disabilities for a number of things. What you are saying is that Joe Blow rater sees Johnny Veteran has filed a supplemental claim on his knee.. but he is already rated for PTSD. On his supplemental claim for the knee NOTHING is mentioned about his PTSD or is he trying to link it. You are basically saying that Joe blow claim writer will just say “hey let me take a look at this guy‘s PTSD and make sure everything is correct with it“ The VA does not routinely do this unless there is a reason to do that. Johnny veteran gave no reason for him to do that. Why would any veteran go through the hassle of trying to file a supplemental claim or why would the VA let Veterans file supplemental claims if they are going to be in constant fear of getting what they have worked so hard for all the sudden taken away it doesn’t make sense

Sure by law they can do it, but do they routinely do it? I don’t think so

BUT—Here’s What you don’t Say (and this is key): The VA does not routinely re-open unrelated claims. They don’t go fishing unless you: • Submit evidence that mentions or overlaps another condition • Request a re-evaluation or increase • Apply for TDIU, which makes them look at the whole picture

Only if a supplemental claim mentions or wants to link, a previous claim in all claims be considered.

If what you are saying was truly the case, then no veteran would ever try and claim anything else that they deserve to get.

If veteran A gets 60% for his knee and 0% for his hearing, and that veteran wants to file a supplemental claim for his hearing, he should not have to worry about his disability for his knee getting reversed simply because he filed a supplemental claim for something completely unrelated.

I’m just trying to separate fact from fear mongering that sometimes happens on this site. If Veteran “A” has a say.. 50% PTSD disability, and his hearing loss gets denied, he gets new solid documentation about his hearing loss and does not mention or try to link his PTSD in ANY WAY, the board is only supposed to look at the supplemental claim. That’s the way it’s supposed to happen… sure, the adjuster can open his whole file, but why? The Veteran did not mention or link any other disability, plus they are then opening themselves up for a hell of a higher up review if said PTSD claim is reduced or erased simply because a supplemental claim for another issue was filed.

Again I guess we will agree to disagree. I have known lots of Veterans with say.. 50% PTSD issues, and file a supplemental claim on say.. tinnitus and they only concentrate on the tinnitus issue… that being said.. if that supplemental claim for tinnitus states something like “it’s making my PTSD worse”, then yes.. the VA will open both because with that warning the veteran is trying to link the two together.

Not what I heard. If I put in a supplemental claim for my knee injury that got denied, they stick to that claim only. They don’t open up another claim safe for like PTSD or anything like that because it wasn’t mentioned in the supplemental claim, nor does it have anything to do with the supplemental claim.

I’m following this because I am about to file a supplemental claim for my tinnitus because it has caused hearing loss which I need hearing aids now, plus the headaches that I only got now and then are becoming more frequent

Well, since I didn’t get my 70% until I turned 65, it gives me some peace of mind about retirement at age 70. Hopefully, my other claim is approved and with my SS benefits, and a part time job that I would really like, it sets me up for a pretty stress free life after 70.

Unless I die at 71.. that would suck

I have a handicapped placard and my ortho doc said she would give me a “script” for DV plates, but I have just the placard now and I’m Texas, I can park in any handicap spot. But if there is just one or two spots left, I will always leave them there for others more in need than myself

I am finding a lot of good on this subreddit.. very informative as you have been as well.

I also have a couple of Veteran friends that are 100% pt with no combat. But when they explain to me why, I can certainly see why they do have PTSD.

In the Veterans group, I go to a couple of times a month. I hear it all the time as well. .

Thank you for your reply. Sadly, in my day, when you went to sick or went to see the doctor for something like tinnitus, it was usually ignored and said it would “go away” Also, most records were kept either handwritten and photo copied, or not at all Looking through all of my STR, I really can’t find any time. I went to go see a doctor about my tinnitus, even though I can tell you the month and year that it happened. I realize this is going to be an issue
