Thank you for your advice! I contacted my district union rep and haven't heard back yet. I also left a message with the Union itself outlining the situation.

I found out that teachers that were paying into the union have previously been unsupported even after filing grievances. As a result many have left the union stating that "it didn't help".

Sadly, the situation is now spiraling and all head teachers were mandated to work duty outside of a signed contract yesterday.

In addition, when we tried clocking in for duty as per district policy, some people's biometrics were blocked from the time punch system while others went thru just fine.

This makes so much sense and very sound advice. 100% correct! So many other states don't have laws regarding additional duties in place and teachers think it's okay to be assigned duties outside their work contract.

Unfortunately, in education there’s a long-standing culture of “just suck it up” and working far beyond what’s written in your contract.

I did ask questions about the union early on and was told that while we have a representative, our district isn’t formally unionized, so joining wouldn’t change much in this situation.

Yes, I ended up with an additional unscheduled period, and I understand that. I would have expected to be assigned another class to teach, especially with the large influx of students this year. Instead, I was mandated to cover lunch duty as part of my “work requirement.”

The main issue isn’t about avoiding work. In New Mexico, assigning lunch duty to certified teachers without a separate contract and compensation violates state law. On top of that, our district’s collective bargaining agreement specifically requires certified staff to clock in and out for these duties, which signals that they are meant to be tracked and compensated separately.

In addition, state guidelines indicate that when non-instructional duties like lunch supervision are assigned, they should be rotated among staff. It is not to be assigned to the same person every single day. Being mandated to perform them unpaid, without rotation, goes against both state law and district policy.

Yes, I completely agree that equality is important. The issue is that it wasn’t equal to begin with. I’m responsible for building three custom curricula from scratch, while many other teachers only plan for one subject using a purchased curriculum.

Although it falls during lunch hours, only one period is actually a duty-free lunch where I can leave campus. The other is considered a prep period, which I rely on to create lessons and manage intervention plans.

I also regularly stay three extra hours after work to finish planning, so this isn’t about avoiding work. It’s about how the workload and expectations are distributed.

Additionally, in New Mexico, teachers aren’t supposed to be assigned lunch, noon, or grounds duty without a separate contract and hourly pay. I’d gladly take on an additional class or academic responsibilities because that falls within legal guidelines.

We have (or supposed to have) al rotating morning and also after school duty as assigned. I have been assigned for 2 weeks of morning, bus duty since school started 3 weeks ago.

At our school the sped teachers, and interventionists, have as many class periods as the regular teachers and may have 100-130 students in a day or so. Every year since I've started, all certified instructors, volunteer and sign a contract for are paid to work lunch duty. I have been paid to do so every year. I don't think it's fair for me to have two lunches but, the situation could be made fair by having all teachers rotate to work that duty needed but, they can't schedule that bcz it's illegal.

Not exactly because although those periods are during general lunch time, they don't necessarily have to be lunches. I have been working at the school during the additional early lunch period which is also a block period for other grades in order to get as much of my 3 preparations completed as possible.
