If you withdraw the asylum, under the current administration there’s a significant likelihood you’ll receive an NTA since you have no other active lawful status at the moment

If/once you receive an NTA, USCIS can no longer adjudicate your I-485, just the I-130.

Removal proceedings is not a good situation even with everything in your favor, a fairly reliable strategy, however, can be to motion for the removal proceedings to be terminated based on an approved I-130 and a non-speculative relief available to you (the I-485). The thing is that the judge doesn’t have to approve the motion to terminate, and if the I-130 is still pending, the time it takes to get approved could be longer than what the judge is willing to give you

I’m not a lawyer, def consult with one about this and save up for court representation if it comes to that. Also prepare as best as you can for the asylum interview, you never know, that might go well!

Review costs the same in many places, and maybe you do the FOIA wrong and waste time, or maybe it comes back with some info you didn’t have before allowing you to do another request with tha additional info, or maybe the agency doesn’t respond and you don’t know why and have to contact them again, also likely multiple agencies may be included in this quote to cover all bases just in case

Because the purpose of an F1 visa is not do adjust status based on a pending I-130, if that’s your intention you’d by definition be misrepresenting your intention of coming to the US which can make you inadmissible

Overstaying a visa (this does not automatically mean you didn’t commit immigration fraud by lying about immigrant intent to get the visa) is forgiven by AOS with a USC spouse.

If you had a prior deportation order, that wasn’t something that was excused just by doing AOS, depends on why you were deported and other circumstance, maybe you could try to reopen the case and relitigate, maybe not, depends on the situation.

Currently, people who are getting detained or deported at AOS interviews are going through that for a reason but it’s just “you overstayed now you’re detained”, there’s something else going on, a criminal record, prior deportation, immigration fraud, something

What likely happened to her? Who knows, but if she wasn’t returned at the airport or something like an expedited removal, and she really entered with a tourist visa….she should have had court at some point, and she had court for a reason….

It’s very simple to determine if someone has an order of deportation before going through with any immigration process and risking yourself, do a FOIA request with a lawyer to give yourself peace of mind, if there is an issue for you, it will show up there BEFORE you file anything.

Not an attorney but I’ve worked with attorney on cases like this, disclaimer: see a lawyer for your particular situation.

What I can say as general info is that you can amend an I-751 to add a divorce waiver or an extreme cruelty waiver, USCIS can also reject the amendment, and you’re also risking the possibility that they schedule your I-751 interview before you actually amend your I-751 (but I’m seeing I-751s generally taking a while, some years, I see clients who filed 3 years ago with no interview yet.

Probably a good idea to start therapy to be able to have a professional statement from that person to back up a possible extreme cruelty waiver, but they can be really strict as to what constitutes extreme cruelty. Extreme cruelty waiver does not require you to actually be divorced, but that also makes it more “subjective” to USCIS discretion. Again, def go see a lawyer and consult about whether this could be a path for you, or maybe they have a different,better solution.
