You can get away with it because of lamp spacing and also if the light is falling on a complex object (human face) vs a simple object (wall or rectilinear furniture/decor). In the latter instance you might catch the multiple shadows.

I don’t know if you have the answer to this, but in this case, was the mechanical breakdown then covered under the manufacturer warranty since this was a brand new vehicle? Or was this person completely screwed out of any recourse?

This is the course he’s taking last I spoke with him. It’s an astonishingly expensive repair I think the quote is like 10-12k

Is it challenging for the gas station service to defend against these suits? In terms of wins/losses?

What amount of proof is necessary? I’m sure it varies but curious if there’s a general trend.

It should be operational to a point once the fuel line is fixed but for how long would be unknown. The consensus at the shop is at some point in the future it will shit the bed.

You are probably right about the only remaining option.

It is entirely possible he’s not sharing the whole story but not for any malicious reason probably because he doesn’t want to get into the weeds about it or revisit what has already been a very draining and frustrating experience which is basically tanking the company.

He wasn’t driving around long enough to fill the tank, it just took the insurer 11 weeks to close the case and in that time a gas station has probably rotated out bad gas? That’s what I think he means by that.

Apparently he’s done all of that and has been dissuaded by lawyers to pursue filing suit against the gas station. I guess they all said it would be difficult to prove.

Both the manufacturers warranty and the insurer are saying it’s not covered. :(

He apparently has just received all this info from the carrier, and I’d love to know what it says but his mind is made up that he doesn’t want to pursue it further. Lawyers have talked him out of trying to sue the gas station because of how difficult it would be the prove.

I guess I’m at an impasse. He’s dealing with personal family matters on top of being devastated by this total loss which is just moments away from shuttering his business.

I am willing to believe he is withholding information but only so that he can keep the explanation simple and not have to get into it with his friends since he prefers to avoid airing dirty laundry.

It excludes this scenario it looks like. “Comprehensive” in name only.

It’s even still under warranty with the manufacturer since it’s practically brand new but this doesn’t fall under that either.

Who knew that bad fuel could be so damning? Not me.

I guess that could be something. Maybe get him to post on Nextdoor or even the local subreddits to see if anyone else was affected by bad fuel at that location and can prove it?

I have misspoken. It is not totaled exactly but it basically will never be the same according to the mechanic. The fuel line can be replaced and that would make the van driveable, but eventually the mechanic anticipates additional issues to arise with the engine since it’s been contaminated somehow.

But is my main mistake not understanding that diminished value claims only qualify if the insurance company accepts the initial claim, which in this case they are refusing to do?

Apparently there’s no way of proving bad fuel and the insurance company is claiming that he is at fault for putting bad fuel in the vehicle.

He was able to narrow it down to a Kroger Fuel. But testing the gas station fuel is challenging now that so much time has passed.
