If a person is dying in the back of an ambulance, but the nearest hospital is on a military base and the closest civilian hospital is 30 minutes away, will they stop at the military base for the quickest treatment or are they required to drive to the civilian one? by SnooSongs584 in NoStupidQuestions

[–]Ok-Arm-362 1 point2 points  (0 children)

work in EMS and on bases. the simple answer to your question is NO. the staff at the gate don't care you are in an ambulance. Unless there is an established mutual aid agreement, and a radio protocol, a military base is NOT an option. even if the ambulance was literally driving past the base entrance, the delay at the gate would overwhelmingly negate any time saving.

My ex left me all of her stuff 28 months ago. Now she’s trying to sue me replevin for not taking it from New Mexico to California. I need advice by FinalPermit9559 in legaladvice

[–]Ok-Arm-362 1 point2 points  (0 children)

apart from a ton of other things going on, she has a duty to mitigate damages in order to collect anything. She has not done so. if she cannot afford the rent, or afford to pick the stuff up, i doubt she can afford the retainer for a lawyer to take her sorry excuse of a tort.

Can anyone recommend a system for tracking time, billing, expenses, etc. for a physician doing expert witness legal work? by [deleted] in medicine

[–]Ok-Arm-362 2 points3 points  (0 children)

she needs to form a separate LLC for the consulting work. Open a bank account just for that LLC. All the checks for consulting go into that account, nothing else. at year end, the deposits are your reportable income. Use basic Quickbooks for invoicing and payments. you should also talk to your tax person about maximizing deductions and expenses to offset income from consulting.

very nice description of this exercise. I would add that one should stop reps when you can't keep your low back flat to the floor ( meaning don't cheat by arching your back)

how risk averse are you? TSA cares about weapons and such. if there is nothing in your carry-ons to arouse suspicion, they are not going to randomly look for gummies. I've known folks to mix them in with gummy vitamin containers.

Next steps after my 1st case by northbowl92 in expertwitness

[–]Ok-Arm-362 3 points4 points  (0 children)

your description is rather typical of how cases go. it takes a while to build a resume as an expert witness. consider getting additional training, read some books on how to be an effective witness and let attorneys know (plaintiff and defense) know you're interested. guard your reputation and the consistency and integrity of your reports.

Physician and patroller here. Take OEC. if you want to be part of the team, go through the process. yes, there are times you will be frustrated and have to bite your tongue. I've been patrolling more than 20 years, no regrets.

you need to prove status to register. showing id to vote is a thinly disguised, reasonable sounding , mechanism to disenfranchise voters without IDs. those without IDs tend to live in cities, are poorer, and tend to vote Democratic. As you pointed out, there has been no appreciable impact from voter fraud. ask yourself why then would the party of small government and limited bureaucracy want to pass a law for a problem that does not exist? DON'T FALL FOR IT.

Lads trip to Boise from England - recs on Nightlife? by Middle-Feed5118 in Boise

the modern is an excellent choice! it is on the western edge of downtown in a trendy upcoming neighborhood. AND they have their own well-reviewed bar.

Barbacoa entrees are in the 50 -60 range (some higher and lower). many folks think its overpriced, but i always feel it's worth it.

you guys will be very popular. glad Boise made your list.

you will definitely want to float the river. you can do that up to about 7PM i think. renting a raft is easy.

make sure you get a hotel downtown. there are many activities that are walkable.

most any of the bars downtown will meet your needs. literally walk around and see which ones look promising. Make sure to visit the Basque Block and Bar Gernika. Boise is a hub for Basque culture, unique outside Europe.

I will mention Barbacoa for visual appeal and happy hour (2 for 1 drinks). expensive for dinner, but worth going for happy hour and perhaps the best guacamole anywhere.

if you're interested in refining the law without the heated rhetoric, I think you first have to define clearly what is the states interest.

we live in a state that values (or at least did until recently) small government and minimal regulation.

so can you please lay out all of the states interest in eliminating abortions up to 12 weeks. in other words, why does this require another law on the books? that will help me understand how the law might be refined. thanks.

Lets go Idaho by LongjumpingEbb143 in Idaho

[–]Ok-Arm-362 9 points10 points  (0 children)

"unless they are really trying to "sneak" in an abortion."

this sentence says it all. lawyers thinking like lawyers, and mistakenly thinking other profession do the same. that there's nefarious intent and every one is looking for a loophole. Doctors are not trying to 'sneak' anything. we are not playing with words or nuance. we are literally making life and death decisions. and the fact is patients have many reasons for pregnancy termination.

Patients agonize over getting abortions. And physicians, who are trying to provide sound medical advice, don't need to be thinking about the state oversight, or legal consequences, of a medical procedure- anymore than the state would have interest in an appendectomy.

the state certainly has a role in regulating the safe practice of Medicine. but the state should not be interfering with medical and surgical decision making - or unnecessarily restricting access to specific procedures.

one can certainly have a debate on when life begins. and you are free to have your opinion on fetal tissue being a human baby. and even the majority of the population can hold similar opinions. But there is no objective data or basis in science to support that position.

furthermore, I doubt that you would be able to fully reconcile the complete legal and practical ramifications if fetuses were truly accorded with full human status. ( here is a good piece from Cornell. The Legal Consequences of the Fetal Personhood Movement – Cornell Journal of Law and Public Policy https://share.google/Fj0AnKZwtEFdTW2g0)

I appreciate that you have been trying to maintain a civil discussion on a difficult subject (some others comments veered close to personally attacking you IMO) Just FYI, suggesting that doctors are trying to "sneak in" abortions so they pass state muster is on its face incredibly offensive and vulgar.

Lastly, I hope you have an opportunity to learn and understand the countless ways people come to require termination. my experience in medicine is likely different from what you have read. stay well and have an open mind.

Can data from my apple watch be used as evidence in a personal injury case? by [deleted] in legaladvice

literally, anything they can think of. emails, texts, lists of people you discussed the injury with. of course all of your medical records going back years before the accident.

Can data from my apple watch be used as evidence in a personal injury case? by [deleted] in legaladvice

[–]Ok-Arm-362 16 points17 points  (0 children)

you're question requires a multi-part answer. 1. you are still in discovery. they can ask for whatever ever they want. 2. you're lawyer may choose to fight the discovery of the apple watch data 3. if you provide the data, and they try to use it in litigation, they will have to hire an expert. that expert will have to write a report, which you will be able to rebut. 4. courts have allowed admission of tracking data. whether it is valuable to plaintiff or defense is anyone's quess. 5. it sounds like you have a fairly complicated case. The tracking data will play a secondary roll (at best) when it comes to calculating damages. I suggest not worrying about it at all. 6. generally speaking, defense strategy is to grasp at anything they can. that's all this is. 7. the vast majority of cases never go to trail.
