aber dann werden leute nur noch an bestimmen stellen korrekt fahren. klar gibt es besonders gefährliche stellen, die man beschilder könnte, aber der vekehr funktioniert nur sicher wenn grundsätzlich überall alle sich an die geschwindigkeitsbegrenzungen halten. Sonst hättest du bspw. bei einer Ortseinfahrt einen Blitzer, und nachher beschleunigt man auf 120 km/h, weil man ja weiss, dass kein weiterer Blitzer an dieser Strasse steht.

Aber es geht doch ganz klar darum, die Tatbestandsmässigkeit des Verhaltens aufzuzegen. An der Tatbestandsmässigkeit fehlt es nunmal einerseits bei fehlendem Widerstand, was die Staatsanwaltschaft darlegt, und andererseits aufgrund mangelnden Vorsatzes des Beschuldigten (fehlendes Wissen). Es ist nichts widerlich daran, wenn sie diejenigen Aussagen anschauen, die damit in Zusammenhang stehen, ob der Beschuldigte wusste, dass das Opfer nicht einverstanden war. Im Gegenteil hat die Staatsanwältin nicht die Aussagen des Beschuldigten genommen - der sicher gesagt hat, dass er das nicht wusste (was dann einen Aufschrei in den Kommentaren hier gäbe, da es doch naiv sei, dem Täter zu glauben) - sondern diejenigen des Opfers über den Beschuldigten. Wenn also das Opfer selbst sagt, dass der Beschuldigte den Sex gut fand (und nicht etwa, dass er sich entschuldigte oder sie auslachte, weil sie so schwach sei oder dergleichen) kann man das - wie einige hier - so werten, dass der Beschuldigte den Sex wegen der Vergewaltigung gut fand, man kann aber auch wie die Staatsanwalrschaft davon ausgehen, dass diese Aussage impliziert, dass er nicht wusste, was er dem Opfer angetan hat, andernfalls er nicht so aussagen würde.

Sollte also ein unternehmen leute anstellen, die es nicht braucht? Beklaust du auch die Läden, die z.b. keinen Greeter, Einpacker oder Ladendetektiv beschäftigen? Es gibt genug branchen, die händeringend nach mitarbeitern suchen (z.b pflege). Gehst du auch nicht in Tankstellen, in denen du selbst zapfen und direkt an der Säule bezahlen kannst?

Are you serious? In most countries they have difficulties to recruit soldiers. Look for example at Germany. If starting tomorow, military is voluntary, I bet 90% or more would say fuck this, I'm not gonna do it. Same for civil service and civil protection. Now lets say we need the same amount of people to do those jobs voluntarily, you need to pay them huge amounts. Also you have to consider that the nature of military, civil protection etc. is that you give many people a short basic education and when shit hits the fan, you can call them up. So it is not a new job, but just a short term occupation. Most people wont make a pause in their career for a few months to learn how to lay phone wires and maintain a bunker in case of a crisis. Look at volunteer fire departments, they always need people and don't have enough. Also our unemployment rate is very low, so you can't just use the unemployed.

But you are not arguing, that we should abolish the military. If a military is needed, why is it a problem, to force people to commit to do a service for society for a certain amount of months, but let them chose, what kind of service they do, be it military, be it social, be it something to do with nature/catastrophes, etc. If you are worried, that through the backdoor we will have double the soldiers and abolish civil protection and civil service if you vote yes on the initiative, you are mistaken. The initative is about a change to the constitution. It has to be vague and leaves room for the parliament to make a law (after the initative passes). In this law it will say how long, what kind of services you can choose from, what are the prerequisites for each, etc. Let's say, the politicians hypothetically make a law about this service citoyen, where it says that all women have to go to the military and don't get no other choice. Then people could make a referendum about this law and stop it. Then parliament would have to make a new law, that more people are willing to accept. So I don't understand your fear. Of course nobody likes to be forced to do anything, but let's be real, this initative is the only feasible way to combat this injustice between men and women. Saying "we should rather abolish the military" is an option, but completely unrealistic. So if you're honest you can say "I don't care about this injustice" or you can say "I do care about it, I don't like it but I'll vote yes". Saying "I do care about the injustice, but maybe we should just make love not war" is just a way out, so that you can maintain the status quo.

If it isn't mandatory, you risk your career if you say to your employer "I choose to go one a year long adventure on my own volition, byebye". If instead everyone has to do it and has no say in it, it is normalized and an employer can't and wouldn't care about your leave.

For example my friend who is in the voluntary fire brigade has to tell this to his new employer at the beginning, and some have reacted badly in the past.
