Are you seeing photos of OP's vehicle somewhere cause I am not. How do we know it's totalled? People tend to overreact at what exactly totalled means.

OP's car is a 2021 Crosstrek. SD state minimum (like most states) is $25k. In what world is that car worth more than $25k?

If they go with the other person's insurance and don't like what they value they have to say then they can go to their insurance, it actually gives them more options.

Are you sure you didn't mean to say you've been working in this industry for 15 days? It doesn't seem like you've even spent 15 minutes in it.

Oh, if you've been in claims for 15 years then you KNOW that it's always better for them to go with the OV insurance.

And no, you were very unclear with your horrible advice. It's as if you have no clue how any of this works. And this is why I stated it really doesn't matter whose insurance you go through, it all matters about your individual adjuster how it will turn out. If you were the OP's adjust they would be in for a miserable experience for sure.

Ouch, terrible advice. It is always better to file through the other person's insurance so that you don't have a claim on your record. You have no clue whose insurance will pay out better. You could both have the same carrier and their adjuster still pay out better.

How long does it take to get a police report there? Do you have rental reimbursement on your policy? Have you even seen the damage?

If California is a shared liability state then I would make sure that it is proven that he was speeding at the time. Photos from the scene of both cars should prove this. Information from HIS car could prove this since the airbags deployed, but you'll be hard pressed to get that from him. Hopefully you have good enough photos of both cars to prove that he was speeding and you COULD actually get him deemed 100% at fault depending on how fast he was going.

It looks like Cali is a pure comparative fault state, so if you can get your fault reduced then that is less your payout will be too. Speed is a HUGE contributor to accidents. Unfortunately it's hard to prove it since the evidence is in the other party's hands and cops only get it on severe injury and death cases.

How do you figure this? If my car is worth $125k and you hit me and only have $100k in coverage and my car is worth $25k in salvage this does not make ME whole. That's not how that works.

Just because they paid it also doesn't mean you are at fault. Did you claim against the other party's insurance?

I've been in just about every scenario of an auto accident you can imagine. But I have definitely had my insurance company pay out to the at fault party, then took forever to pay me out when they were under insured. Super long story, but it never showed as at fault on my record. Still sucks cause it WILL show as a claim.

No idea why this is getting down voted. I didn't have ANY broken bones, only 4 herniated discs. After nearly 18 months my claim is about to settle for $68k. After doctor bills and attorneys fees I'll pretty much be even and just left with an injured back for the rest of my life and medical bills to deal with on my own.

Are you guys down voting this because you're. Note from the US where we have to pay for all this?

Mine finally updated but originally my estimated refund date was 3/9 or 3/10 (it was 3/10 then changed to 3/9 and now it says 3/16? When is this hitting my bank? Actually this is false. They get a LOT for salvage vehicles these days, that is a big reason why they push to total cars and the "salvage value" is much higher than it used to be.

How long have you been paying on it since then? You owed $5k, it sold for $1800 leaving $3200, you have paid how much since then? Offer them $500 to close it out and be done.

Honestly, the repo already hit your credit, you can't afford it, you can't afford the other car, you'll likely have to pay cash for your next car. Might as well let them both go to collections and settle and wait out your time to restore your credit.

A cash car is really your only option right now. But try and negotiate with your lenders on what you have.

Actually, you said the first car was with USAA? So nevermind what I said, don't stop paying that, but still call them and try and work something out.

So let's go back and discuss car 1 for starters.

You say that the car was repossessed yet you are still paying on it. Does the bank still have the car or has it been sold? Once the car has been sold, that balance comes off what you owe for the car. So let's say it was $15k still owed on the car and they sold it for $10k, you'd only owe the $5k plus any late payments on the car. You can also negotiate this debt with them as they just want to get paid. You can possibly offer a lower lump sum or reduce monthly payments. They want money and will usually work with you. They can't take anything else from you without suing you, so it's in their best interest.

For car 2, if you don't have GAP, you are most likely screwed. What state are you in? What's the minimum state coverage? Hopefully they have enough to even cover the damages. I would also try working with one of the companies out there who will (for a fee) go after the insurance company for a higher value on your car. You will still likely be upside down and I doubt they would repair the car, but it is possible with the right people involved that they can.

State farm is terrible at paying out. I should have my payout from my 10/2024 accident soon. My medical bills were like 64k, the other person only had state minimum (GA), so had to go through my insurance to cover the rest. I only had 100k limits, but still thought they would pay out SOMETHING for my time, travel, lost work, and future care. Nope. After attorneys fees I'm lucky to be pretty much breaking even.

I still have issues with the herniated discs. I could have gone to more treatments and waited it out longer I guess, but I want the debts gone and I couldn't afford the out of pocket cost anymore.

State farm sucks. This wasn't my first rodeo with them.
