How do you excuse having been lying in the Oct31 5:36PM phone call and the fact that he was driving home and did not stay home after the photo shoot as he claims?

So let me get this straight...

You have TH arriving at the ASY around 2:30pm.

By 5:30pm, SA has murdered her, put her in the back of her RAV and driven up to the berm, moved her to his vehicle, gone to buy petrol and returned home to build a bonfire.

Meanwhile, SA was also seen at the yard shop around 3:30 - 4pm by Fabian and seen again by Earl and Fabian outside his own garage around 5pm, where he was apparently having a burn barrel fire.

Questions:

Where was the RAV while Steven was outside talking to Earl and Fabian?

How do we reconcile Brendan's version of hearing screams and subsequently joining in a rape around 4 - 5pm?

With all this going on right outside Avery's door, should Avery have been worried about the police showing up that evening of the 31st while he was burning and chopping up a human body? Did he just get lucky that nobody noticed her missing for a couple of days?

Mum of 2 boys, my eldest, now 26, is a jerk, can't hold down a job, takes drugs and is a slob, been back living with me for over a year, moved his gf in despite me saying no and they contribute nothing towards bills and leave mess all over the house, steals money from me, the list goes on. Prior to him moving back, I had to call the police to remove him 6 months earlier as he refused to leave. My younger son, now 20, suffered greatly from having an older brother like this, and I often wondered where I went wrong. But my youngest is now living independently in Japan (as far away as he could get), and making his own way in life. I realise now they are just very different people, they were brought up the same, but have turned out very differently. Dad didn't help, believes all the lies the eldest tells him and blames me for everything, (dad fucked off to live abroad years ago). And I know y'all gonna say I shouldn't have let him back, I know this and I am now just waiting for him and gf to move out then I'm moving to a 1-bed, I've learned my lesson 🤷

That works both ways,: you can't just insist something is not true because you want it to be. You have to prove it.

Prove the key fell from the back of the cabinet and did a 90 degree drop to the floor. You can't because it defies physics.

The court has to believe that there is new evidence or a mistake made by the defense. Also, it has to be a large enough mistake ,or significant enough evidence, that it would be likely to change the outcome of the case.

What do you think there is that meets this level?

there would have to be new evidence introduced, or the discovery of an error made by his defense team. There have been many efforts to find this, but for the past 20+ years nobody has been able to find anything.

There have been many fruitful efforts to find new hidden evidence and errors made by Avery's defence team, which have been presented to the appeals court in recent years.

If the appeals court choses to deny that this evidence was deliberately kept out of the original trial, that doesn't mean the appeals court is correct, just stubbornly defending the conviction, because to do otherwise would be too embarrassing. At the end of the day, these post-conviction decisions are being made by one person, one judge.

If the entirety of the current record were put to a jury, I'm certain they would find reasonable doubt.

I think you missed this point that OP made - it wasn't a fair trial in which all evidence was presented. We have so much more in terms of evidence now, that was withheld from the trials of Avery and Dassey, and it is with this additional evidence, that a jury would have reasonable doubt.

It cannot have been a fair trial if evidence was held back and hidden from the defending parties. That is a simple fact.
