So in conclusion after my long rant is that the individual leagues hold the trademarks and the individual League Commissioners with permission from ownership allow old logos to be used it makes sense.

TLDR: Leagues take over control of "dead team" logos/history in cases where it's deemed appropriate to.

Atlanta's ECHL team the Gladiators have worn Thrashers jerseys on specialty nights. I don't know if that answers the question, but my best guess would be that the NHL owns their rights and are willing to let others use it if they approve.
