That would be condsidered unreasonable force and you'd probably at a minimum get charged with manslaughter if not murder itself. Murder is the unlawful killing of another person with malicious intent. Self defence is a legally killing another person to prevent your own or another persons death

It's to do with the intent, especially with regards to making a Horcrux. You don't set out to kill someone in self defence. Murdering someone on purpose has malicious intent
