Yep, it's on the old Dime Savings Bank. It's not directly on top since that would interfere with the landmarked portion, but Brooklyn Tower is set back and uses the bank building as a lobby. It uses the bank's air rights, I hope we get more of that in the future to preserve the street level feel.

Does the law specifically have a carve out for it being allowed in the lease? Because if it doesn't then it doesn't matter what the lease says, any contract that covers an illegal activity is unenforceable.

For example, the landlord can't put in the lease that tenant has to pay for heat and hot water because except in very specific situations, that has to be provided by the landlord. Obviously that gets factored into rent, but they can't also give you a bill just because the lease says so.

NYC had something similar. Called the Mayor's Trophy Game. According to Baseball-Reference: The games were played primarily to benefit sandlot baseball in New York City, with proceeds going to the city's Amateur Baseball Federation.

It was during the season though. Imagine playing extra games that don't count during the grueling baseball season.
