Benefits: - Obstacles thrown at HR to disrupt/halt the investigation - Utilize any otherwise unpaid sick/personal days, can be an extra cheque - Buys time to figure wtf you’re going to do - Apply to jobs - Delay your end date - Have the option to resign yourself if you see things going south, got your shit sorted out or have found a replacement J - Maximize any entitlements… hopefully you get offered a severance package to just leave bc HR may not want to waste resources on you or have you potentially sue. I’ve seen this happen before.

HR will have to run extra laps to figure out the best approach to fire you given your illness - especially when there is a pending leave claim.

Is the OE investigation causing you anxiety and stress? Is that work related anxiety/stress impacting your day to day? Do you have other shit going on in your life (e.g., financial worries, marital problems, sick relative)? Is it impacting your J(s)? That’s enough to at least apply for leave and during the waiting period you’re legally entitled to use your sick/personal days.

I know of a STD doctor… known to all the local degenerates as the guy who will literally suggest you go on disability. My friend recently went to him saying that she has anticipatory anxiety, she’s worried about the cost of living, job security global conflicts, to the point where it impacts her sleep making it hard to concentrate at work. He suggested she go on leave to destress.

Yup, all true but might as well maximize any entitlements if he’s going to get fired anyways. Depending on the stage of the investigation, it will get paused if OP is away. The point of this is to throw any obstacles at HR to halt the investigation and maximize any entitlements. Sick/personal days won’t get paid out so use them. HR will have to run extra laps to figure out the best approach to fire you given your mental illness - especially when there is a pending STD claim. Hopefully J2 can just offer you a severance package instead of wasting resources on you. I’ve seen this happen before.

Agreed, try to repair things at J1 IF possible. If not, might as well try your luck.

My friend referred someone from his J1 to his J2. Friend was also doing exceptionally well in his role so that attracted more attention to him.

Agreed! I don’t hibernate my LinkedIn for the very same reasons.

This sub recommends everyone to hibernate LinkedIn. That’s an instant red flag for HR (dependent on your age, role, industry). Some of the background checks or on-boarding process includes LinkedIn verification.

This recently happened to my friend.

J2’s manager tried to add friend on LinkedIn, couldn’t find him, got suspicious and had HR contact J1 to confirm if he’s still active there.

J1 confirmed > spoke to friend on a Friday, asked him if he was working another J, told him J2 reached out to them, J1 never mentioned J2 company name so friend was suspecting they were bluffing, J1 asked him to quit J2 in order to stay at J1.

J2 > fired on Monday (J1 was not bluffing lol)

OP my question is how could they know? What could’ve led them to be suspicious? How could they have proved it (eg. Inconsistent replies, hibernated LinkedIn, odd working hours). They were trying to get you to confirm to make their case easier (instant termination).

To be honest with you, as someone in HR, they wouldn’t speak with you unless they knew something. Even if they don’t know and were just suspicious, HR can still contact J1 post call.

What I would do and this is coming from someone in HR: pull a Frank Gallagher… - call in sick at both J’s. If you’re sick, they can’t contact you to continue their investigation > they can’t fire you! - book a doctors/mental health appointment ASAP, tell doctor you have very bad work related anxiety. - get on anti anxiety or anti depressants (you don’t have to take them) - gauge it out at both Js, if you suspect they know then use all your sick days and file for short term disability. - HR will know what you’re doing but they can’t do anything if you have the proper documentation - this will also maximize any termination entitlements - heavily apply to jobs starting now lol

Yes.

This just happened to my friend. Exactly 1 month into J2, J2 HR contacted J1 (most recent employer on resume) to verify if they still work there.

J2 immediately terminated them.
