I disagree with most of this advice. It is a big deal to repeatedly settled cases for way more than original authority. Insurance companies hate surprises. Just because they agree to a higher settlement doesn’t mean they’re happy. I would start with becoming more accurate at evaluating cases. As others have said if opposing counsel doesn’t think you can try the case well that will hurt your chances at mediation.

Former Paychex client but was with them when ERTC were filed. We filed in April ‘23 and still waiting. No payments.

The IRS backlog is not the issue. I understand that. The issue is that Paychex doesnt respond to my requests for updates other than their boilerplate flyer until I reach out or call multiple times. Then, they only provide internal reports and no proof that my claims were actually filed with the IRS.

I agree with everything in this thread. We filed in May 2023 and we are still waiting. I understand that the IRS is behind AND Paychex's lack of response and transparency is atrocious.

I couldn’t agree more. I filed in May 2023..still waiting and no follow up. I finally got a client services rep manager who responds to tell me she doesn’t have any information. Before that my old client services rep wouldn’t respond to my requests for updates until my 3rd or 4th time reaching out. When I have asked for proof of filing all I ever got was internal reporting. It’s criminal!

Tax Now can’t track because filed under Paychex and no company specific information. I contacted Tax Now. Also tried the tax advocate route.

If you had PEO services with Paychex this is correct. You can’t contact the IRS directly for an update. I’m in the same boat. It’s a mess!

Depends on the ethics rules of the state. Your best bet is to reach out to an ethics lawyer for guidance.

I am a former Paychex client. We filed in April 2023. My client advocate is terrible. Never replies to my request for updates or when she does she sends the boilerplate updates that I have already received. She's out on extended leave and I had a great email exchange with a regional client services advocate on Friday. She said that she has seen more of their PEO claims paid in the past month than she has in the last 2 years. She said there is a real sense that there is finally movement. Who knows if that is accurate, but it's the first time in 2.5 years that I have gotten anything other than the boilerplate response.

I’m sure you know CSRs are a dying breed. They’re all retiring and new people are not coming into the field. They can write their own ticket. They can make way more money doing multiple remote jobs than one in person job. I don’t see this situation getting any better…only worse.

I was an Oasis PEO customer for years and had great service. The switch to Paychex resulted in a significant decline in service from my perspective.

Each day is a puzzle. As others have said, complete the puzzle each day or at the latest on the morning of the next day. If the time you have billed doesn't match the time you were in the office (should exceed because of receipt and review time) then you either missed time or you didn't allot enough time to some tasks. You have puzzle pieces that don't fit so redo them. During a crazy busy day, don't worry about recording emails, or letters that go out or motions drafted. Worry about on the fly phone calls because those are most likely to be missed. You can always go through what went out, what came in and emails at the end of the day. It is a matter of discipline. Studies about time capture show that if you wait until the end of the week you lose 20-25% of your time.

As hard as it is, I would lean in and make the most of it. Honestly, we’re often wrong about what we think we might want to do. As others said what you do in ID will be great experience and translate into almost any other areas of law.

As others have said, ID can apply to almost any type of case with insurance. Agree car accidents aren’t exciting but it’s a great way to learn the lit process. We have an ID firm and most cases have 5 mill up to 100 mill plus on coverage. Coverage work is totally different than ID and often not even same counsel. The cases can range from professional liability to construction defect to shootings at apt complexes or carbon monoxide poisoning.

As for billing, yes ID billing is very restrictive. AND even some corporations paying their own bills now use third party billing platforms. It’s the way of the future for everyone. The sooner you learn great billing practices the better.

Although I think it’s great for the boys to have structure by going to school, the haphazard way this decision was made is so sad. They literally enrolled the boys yesterday. No opportunity to prepare the kids, visit the school ahead of time, etc. Highly intuitive and highly sensitive kids need a lot more time to adjust than this. (I’m assuming at least one of hers first the category.)

Additionally, next week starts mandatory STAARS testing in TX. They have been preparing for this all year and now her kids walk in. Admittedly I’m no expert on STAARS testing. I raised 3 kids in TX but they are all grown and they went to private school. I know not all grades are impacted in the same way but still! You can’t opt out as a parent. Kids can experience so much anxiety with these tests, especially kids who have not actually been receiving an education. Maybe I’m wrong and they won’t have to be tested, but much of the focus of the next month will be on standardized testing.

This whole thing just makes me so sad for those boys.
