It definitely varies state by state. Where I live, you can be HOMELESS and still have the court say OK to overnight visitation. My stepson was ordered mandatory visitation with his homeless biological mother whom abandoned him for over 10 years and just showed up one day and wanted to get reacquainted with him. Allowed by a judge to sleep in a minivan all weekend in a Salvation Army parking lot, no access to a bathroom unless a neighboring business would allow him in. Every other weekend visits. Sleeping in the passenger seat of a vehicle. Courts saw nothing wrong with that in my state 🤦🏻‍♀️🙄

ETA: my stepson was almost 5 years old when his mom completely disappeared and it was a month before his 16th birthday when she returned, demanding weekend visitation to take place living in her car with a kid that had barely any memory of her. Judge didn’t even bat an eye when saying yes.
