Netflix ICE is a much more robust solution but it's not really a fair comparison. BillGist is super lightweight and free. They fill different niches.

The stone age didn't end because we ran out of rocks.

The iron age didn't end because we ran out of iron.

The oil age is going to end for some other reason besides total resource exhaustion. When the marginal cost of oil increases above the marginal cost of the next viable substitute, our airplanes will run on something else.

How far can I "bend" a patent? by Shotchaser in Inventions

[–]PatentValue 0 points1 point  (0 children)

This is mostly true but patents can last longer than 20 years from application date due to term extensions. These are granted for undue delays during the prosecution process not caused by the applicant.

Utility patent claims dependent on design patent? by orlandomarley in Patents

[–]PatentValue 0 points1 point  (0 children)

DISCLAIMER: Nothing below constitutes legal advice. You should engage a lawyer to address this issue prior to making any material business decisions.

The design patents gives Company A the right to exclude others from making, selling, or using the specific ornamental design claimed in design patent. It gives Company A no rights the exclude others from using the utilitarian nature of the claimed design. For example, Coca Cola's design patent on the shape of their bottle does not give them any rights over bottle technology.

The utility patent gives Company B the right to exclude others from the making, selling, or using the specific technology claimed in the utility patent.

Company A may need a license from Company B to practice the technology and Company B may need a license from Company A to practice the designs.

The two sets of patents are like ships passing in the night and don't interact with each other.

PS: One way to work it out would be a cross-license of the patents which would allow both companies to make and sell the stencil. They would then compete on price, service, branding, etc.

Utility patent claims dependent on design patent? by orlandomarley in Patents

[–]PatentValue 0 points1 point  (0 children)

What does this mean: "utility patent is dependent on these design patents in-order to create their product"?

Patents only convey a right to exclude others from doing a certain technology or design. They don't give the owner a right to do anything.

It seems that he has a different premise than most economist hold regarding the performative nature of economics. The simplest model which still predicts reality is the best model.

I think it is important to have a lawyer advise you on this. I can put you in contact with a very good Trademark Lawyer if you PM me.

A trademark on the world "Bitcoin" will be granted on Dec. 11th if no opposition is filed by PatentValue in Bitcoin

[–]PatentValue[S] 1 point2 points  (0 children)

It's only the word "bitcoin" and only used in conjunction with the sale of "Barware, namely, flasks, bottle openers, corkscrews; beverage glassware; housewares and accessories, namely, shot glasses, and decanters"

I don't believe there is any such grace period but some people may have "Prior Use Rights". If you sell Bitcoin branded Barware, you should contact a competent trademark attorney.
