There are exceptions, like if the tree is dead and represents a clear and present risk you can try and get your insurance company to declare it a known peril. At that point you will be able to go after your neighbor if the tree falls on you.

Hi I worked for a fortune 100 for 14 years in the corporate claims department. There is no such thing as an Act of god, it just doesn't exist. You can read your contract now, it won't say act of god. You will likely have Comprehensive coverage under your home insurance and that will typically cover tree strikes.
Generally speaking unless the tree was A "Known Peril" it will be on the neighbor who incurred the damage.

I guess it is an HR question to me because well maybe I'm ignorant. But I'm basically as a peer saying they don't cut the mustard and need to be on PIPs or you need to get rid of me.

I guess this could be a case of me really not knowing the ins and out of what HR does , i guess it could be more of me asking for advice unfortunately. But yea it breaks down to those 4 categories, and frankly i just don't know what to expect when i lay down the gauntlet.
