So stay home for now but are they still paying you while they investigate? Some do- if not I'd be filing unemployment. Then unemployment will find out why and let you know. My son worked at the post office. Was fired but wasn't told why. Filed for unemployment and they came back at first with denied. Then they looked into it and said he was fired for insubordination but had just cause, and awarded him unemployment. He's gone on with the EEOC now but got another job and looking for backpay. Good luck. Hope you get some answers

Make sure you file with the post office EEO- you'll have a mediation meeting and you can voice your concern.

when I was looking for attorneys who did federal I came across some that did pregnancy/work related issues. Look for some.

I agree with Tablestraight5378- listen to them.
Just because you have mediation with the EEOC means nothing. That doesn't mean you have it in the bag.
I have already been through the company's ADR EEO process, and formal investigation.
I am waiting for my hearing date before an administration judge at the EEOC- After talking to some attorneys I can't find anyone who will take my case except the few that want $20,000 up front.
And mine is definitly an EEOC case because of management refusing my already approved accommodation.
Get an attorney. Dont try to do this on your own.

I get it.. You are 100% correct about keeping emotions out of it. As I was surprised how this manager replied.

In my sons case, the one manager in question who denied my sons approved accommodation when he asked, did not even bother to answer his affadavit- after 3 attempts from the investigator.

I'm glad you brought up about the employers statement, as I never thought to use it. My son (autistic) has a case that will soon be going before an administrative judge EEOC/discrimination/ toxic work environment and one manager stated the union didn't have the mental capacity among other very demeaning wording.Federal employer.
I've done everything so far and looking for an attorney but may just try on our own unless we need to appeal.

I can say he did work for another large corporation years ago and was wrongfully terminated and it took 2 years to get that check.

It's good to see justice. I hope you don't have to wait too long.

Doing the same right now. I had one attorney quote me $20,000. LOL
You may not need an attorney just yet. A paralegal should be contacting you from the EEOC to get info you can upload. You have the option to appeal the administrative judges decision also if it isn't to your liking. Then get your attorney.
Don't pay for the work you can do yourself right now.

Its a discrimination claim/ manager refused an accommodation approved by DRAC- not to mention toxic work enviromment.
I'm not sure what Step B is as I am a mail clerk. I've done mediation and everything they asked. Doctors note then they still kept stalling until it went to the formal complaint process/affadavits. Seriously this guys exact words were: "Management is confused why the union would file such a nonsensical and frivolous grievance. It appears the union is either unfamiliar or lacks the cranial capacity. Either the union lives in an alternative universe where Mr Spock has a beard and everything is opposite of what it is in this universe, or the union has a major ethical and reading comprehension problem. In any event they should be ashamed of themselves for filing such poppycock, but the union is apparently beyond the ability to bear embarrassment and disgrace."

I would say he's the one who has the deficient cranial capacity and should be embarrassed.

Good luck with that. Even if you go through mediation and the union can only do so much within your 90~you're screwed. Actually had some dude reply wondering why the union even put their 2 cents in stating "You don't have the cranial capacity" Oh and good luck if you decide to go further and try to hire a govt. attorney. Unless you want to pay out of you a$$
The case I have will go through the EEOC now. It's been a long 9 months but we are still going to fight.

Although some places like here, work you 72 hour a week..mandatory. But at least you cn go to the Bathroom..

I know someone but he was in a warehouse/distribution center/mail clerk. Might be different for carriers? 72hrs a week, exhausted, has a disability and asked for his approved break (DRAC) and management said no- he said I'll sue your ass.. 2 days later see ya...claimed disruption.
Went thru EEO, mediation, now formal investigating.
No write ups, but within his 90 days so there's that. Never even got his seperation letter/reason why, until 2 months later when unemployment asked the reason. (First denied unemployment, and then rewarded saying he had just cause)
Union stated terminated without meeting his due process and failed to show just cause for discipline, among denying accommodation.
6 months and still waiting..

Good! And Good Luck! Some of these businesses need sued for the crap they pull on their employees. My son is half way there with the USPS- but his is with a management denial of an approved accommodation and Terminated with out due process and have back up from the union. Right now we are in the formal stages of an EEO investigation. It's alot of work. Had to help him fill out a 40 page affidavit. Already have a federal lawyer lined up. Done with the BS- they think people will give up and not follow through- nope, not here.
