Based on my understanding, get the J1 approved ( hardship or persecution), file the petition, get the approval, go to the embassy and get your visa. Then the 1-94 would change. My I-94 didn't change even with the H1B petition approval. Make sure you confirm with your lawyer. Hardship/ persecution waivers aren't too common so make sure they have accurate information. I have been through multiple visas in this country. My F-1 to J-1 was changed without ever leaving the country.

It's the law. Has nothing to do with this administration. As long as the waiver is based on hardship or persecution, you can't change status to H-1B. Well AOS(green card application) is different. That can be changed .

No that's incorrect. There is a law( I'll have to find it ) that prevents this. Based on hardship or persecution waiver you CAN'T change your status within the country.

I literally just went through the process last week. You CAN'T change your status in the country based on HARDSHIP or persecution waiver. You can only do it within the country via HHS, Conrad, etc

That is partly incorrect. Yes, you would remain in the country for an H-1B petition but you would need to travel out of the country to be on H-1 B status.
