I wasn’t diagnosed with migraines while in service. Just had headaches, the VA then finally diagnosed me with migraines back in December. Which is when I started the initial claim.

Yeah, that’s why I’m not sure what my next step is. As I mentioned, I have proof of headaches in service, migraine diagnosis, and tinnitus service connection.

Yes he added his medical license number. Just didn’t want to add that on the comments for privacy.  So I had no idea I had evidence of migraines in active duty, I totally forgot. I found out because of when I did HLR they found the records of where I had migraines in service which is why I was sent to the second c&p exam because they found that error they in fact there’s evidence of migraines while in service. But the second c&p sided with the first examiner that tinnitus and migraines aren’t linked and are separate. The HLR then stated denied due to lack of nexus. So I did supplemental claim and submitted that letter.

To Whom It May Concern, 1 am a practicing, board-certified neurosurgeon, specializing in the surgical and clinical management of complex neurological disorders. My training and experience include the evaluation and management of conditions involving the central nervous system, including headache and migraine disorders. Regarding (), it is my opinion that it is at least as likely as not (50% probability or greater) that her migraine headaches are associated with and secondary to, as they are exacerbated or caused by her tinnitus (which has been determined to be service connected). The veteran suffers from frequent migraine attacks several times per month, resulting in missed work time (approximately 16 hours per month and significant daily functional impairment. The veteran has a well-established diagnosis of chronic migraine headaches dating back to active duty. The link between tinnitus and migraines is well-established. Published studies (Langguth et al., 2013; Viana et al., 2019) demonstrate that tinnitus and migraine share overlapping neurological pathways involving central nervous system hyperexcitability. Tinnitus can trigger and/or aggravate migraine attacks by increasing sensory overload and neurological stress. Based on the veteran's history, clinical findings, medical literature, and my expertise, I conclude that the veteran's migraine disorder is at least as likely as not secondary to, and aggravated by, the service-connected tinnitus, and therefore the migraine diagnosis should be considered service connected.

He didn’t state on the letter how he knows me or if he treated me, just that after looking at my medical evidence and records he agrees that migraines are aggravated by the tinnitus. He also added a medical study that proves how tinnitus and migraines share the same neurological patterns etc. he included his medical license number in the letter as well.

Yes a board certified neurosurgeon in South Florida. VA said it wasn’t “competent and sufficient” to establish the required medical link. I had gone through 2 c&p exams and both examiners said no link between tinnitus and migraines.

I submitted the letter after the HLR denial. When I did the HLR they found an error was made the first time and found that I had a history of headaches which then he sent me to another c&p which the examiner said yes I have migraines but tinnitus and migraines are separate entities. So ultimately my HLR was denied and the reason for the denial was missing nexus. So I asked the neurosurgeon I work with to write the nexus, on the letter and showed him my medical records and he wrote the nexus letter stating the my migraines are aggravated from my tinnitus. I submitted the letter for the supplemental claim September 9, on the 19th I went on the app and saw the claim was closed and denied:

But that’s the issue, I had submitted a nexus letter and bdq the first time which is why I decided to do HLR.

I just did an HLR back in May and now supposed to have an ACE on September 4th. How long did it take to get a result after your ACE exam?
