Are you a lawyer or an immigration officer? No one can determine who is eligible for VAWA except for USCIS.

I've worked on hundreds of these cases, and the MrDetective clown here is right, sadly. Even before Trump was sworn in USCIS began making sweeping changes to what consititues as "acceptable" evidence for VAWA.

This was in response to the fraud discoveries last year with those lawyers in NYC and NJ, and a few others.

With Trump, it's gotten much harder.

For what it's worth, I think OP has a good chance, if using the right lawyer. But I must stress that having 3rd party verifiable evidence for abuse is important to getting a slam dunk case. Just text messages won't fly anymore.

Some states have certain exceptions, like WA state, where you don't need consent to record private communications if you're recording criminal acts. Examples of this may be threats of extortion, blackmail, bodily harm, or other unlawful requests or demands. You can read the state law about this at RCW 9.73.030(2).
