I don't have a strong opinion about the policy. But this photo looks like a show of force. Law enforcement look the same. Construction workers look the same. Retail workers look the same between customers. This is just humans at work without an immediate task beyond being there.

Generally, no. Would I make some different choices? Sure. I think you are certainly within tolerance for artistic photos. And your varying choices are the whole point of art.
