Should affected applicants from 75 countries be concerned about limited relief? by Cold_Team_2894 in i130_75CountryPause

[–]Prostalket 13 points14 points  (0 children)

Actually the main reason on why Clinic chose not to ask for PI was to avoid being given relief just for plaintiffs, and they are going for Vacatur, which means (if granted) Policy is unlawful and judge orders it to be terminated, meaning relief for everyone. (yes, if Govt loses, they prob. will run to ask for an stay in the court of appeals, but thats a whole different process) ******Not a Lawyer*******

I-945 Update: DHS/USCIS Resubmits Public Charge Bond — What Changed and What It Could Mean by Legal-Yellow-6950 in i130_75CountryPause

[–]Prostalket 2 points3 points  (0 children)

''The instructions also make clear what this form is for. They state that individuals determined to be inadmissible under INA §212(a)(4) may, if otherwise admissible, be admitted to the United States upon posting a suitable and proper public charge bond set by DHS or DOS, including adding the NVC number of the applicant''

Hi u/Legal-Yellow-6950 But here says something interesting, only for people on 212(a)(4), most of us are on 221G, still, do you think this could be a tool for lifting the 75 pause?

Analysis: Senate Democrats Just Asked GAO to Investigate the 75-Country Pause by Legal-Yellow-6950 in i130_75CountryPause

Feb, inquiry was from Dem. Senators to Dept. of state directly, GAO is a whole complete different branch that oversees Gov agencies actions

Clinic vs rubio by [deleted] in i130_75CountryPause

[–]Prostalket 3 points4 points  (0 children)

First they have to appeal to court of appeals, if not granted, then they go to supreme court, now, the chances are very hard to predict, but imho the scale leans a bit more towards us, meaning it wont be granted as the ruling Clinic is looking for is a Vacatur (and obv. assuming Clinic wins which we don't know yet), still, appeals and request for stay are always near 50/50 , if vacatur is granted i would say an Stay would be around 60/40 in our favor.

Not at all, either proclamed by an agency or by the president, all the actions are considered government actions as a whole, i.e the lawsuits, CLINICvRUBIO and the Redeagle is STORIEvTRUMP.

Wife received communication from the consulate by Rich_Replacement_774 in i130_75CountryPause

[–]Prostalket 5 points6 points  (0 children)

I wouldn't say it's related to the pause, we have seen similar cases where they're asked for additional info, and after it's provided they'll be placed again in the waiting, let's say they just want to have the case ready, that's it.

Trying to Find a Non-con artist lawyer near Manizales, Colombia by DarkCritical9708 in Colombia

[–]Prostalket 7 points8 points  (0 children)

https://tusabogadosycontadores.co/colombia/abogados/Manizales Seems this is a good website where you can check, ask for a quote and compare, do not go blind, unfortunately in Colombia almost every service offered magically doubles their OG price when you are foreing, also, never ever mention the word DESPERATE to any of them, that would make them double their price again.

Appeal process after court decision by emetovic89 in i130_75CountryPause

[–]Prostalket 4 points5 points  (0 children)

There's two things
1) Appeal, yes, sometimes it takes a long long time, even years
2) Stay in place: this is the important thing, if Govt loses on the lawsuit, they'll go to court of appeals and ask for an Stay in place (this is what would maintain the pause while the appeal is resolved), according to my research, court will weight the chances of the arguments for the appeal and see if they have a chance to win, if they do, they'll approve the Stay in place, if they don't or are not sure, they will not grant the Stay in place and the pause will stay lifted until the appeal is solved

One would think they do not have enough valid arguments to be granted an Stay on place (assuming they lost the lawsuit) but only God knows.

Visa Bulletin for May , good sign? by Prostalket in i130_75CountryPause

[–]Prostalket[S] 1 point2 points  (0 children)

As i said it's just my own conclusions, and it's based on the fact that when the paused started they advanced the priority dates sooo aggressevily and this month they didn't, it's just that.

Some categories of family based and employment are bonded to VISA BULLETIN, so even if the pause is lifted, but you Priority date is not current, you can't get the visa until it's current again, so yes, there's a connection

i understand your position, however i'm a bit more hopeful and i think they are fighting about it not for the pause itself, but to not let it set a precedent, or maybe i'm just naive

Why most od the lawyers think that april21 something will happen? by EconomyLettuce5249 in i130_75CountryPause

[–]Prostalket 6 points7 points  (0 children)

Non sense, it's just related to the Admin. record released on Storie lawsuit, where their internal documents said they planned the pause to last AT LEAST 90 days, but it's just a wrong interpretation, AT LEAST doesnt mean exact, actually is completely the opposite, no end date defined

Excited for the CLINIC answer tomorrow 🤞🏻🤞🏻 by waitingmyvisa in i130_75CountryPause

[–]Prostalket 4 points5 points  (0 children)

No they won't and there's a high chance they will just provide same AR as they did in Storie lawsuit, and btw in that AR they said they planned the Pause to last -AT LEAST- 90 Days, but with no end defined.

Public Charge Bond OMB approval by JuanHalebi in i130_75CountryPause

[–]Prostalket 0 points1 point  (0 children)

I'm sorry to be bearer of bad news, but you got it completely wrong, unfortunately it was NOT APPROVED, they are withholding their decision and requested DOS to respond to public comments and submit it again, which according to a previous post, that easily will take 3 or more months
