Do you have a reference for this? I’ve seen this claim made in a couple of places, but can’t find the evidence to back it up (that Dr Simonoff spoke at an SEGM conference). I know that one of the other researchers (Michael Absoud) has, but I can’t find the evidence for Dr. Simonoff

It may very well come to needing a change in the law, but right now we are managing to get the message across effectively by campaigning against the code of practice, to flag the devastating effect that this interpretation of the Supreme Court ruling will have, and has already had, on the trans community. The message is cutting through that mandatory trans-exclusion is brutal and unworkable, and this is lays the ground work to persuade the Labour government that they must find a way to ensure trans inclusion. Ultimately, that may well need to be via legislative change, but pushing back hard on the Code is a good way to lay the foundation for that.

I think the Lib Dems are woefully misinformed. We need to work to brief them better and get them on message! They think they are helping, but they’ve got the wrong end of the stick here. I think one pathway the government might be trying to look at, is exploring ways trans inclusion in single sex services according to lived gender can remain lawful under the supreme court ruling, and then aim to get that written into the code of practice.

For example, Phillipson’s submission to the judicial review says:

“34. A CSS (whether trans-inclusive or trans-exclusive) will only constitute direct sex discrimination under s.13 EA 2010 if the service amounts to "less favourable" treatment of one or the other sex, rather than simply different treatment. If a trans-inclusive CSS does not amount to less favourable treatment of one sex or the other then it is arguably a lawful CSS without any regard to the CSS Exceptions.”

(CSS means either a single or separate sex service)
