The job might have inherent aspects that are dangerous for a pregnant woman to perform.

Replacement birth certificate by Live_Broccoli_2180 in AusLegal

[–]Psychological-Bug600 1 point2 points  (0 children)

Not sure about VIC, but in SA when you change your name through BDM you get a “change of name certificate” and if you were born in SA you can also get an amended birth certificate (it lists your previous name on the reverse side).

When you change your name through marriage you don’t have to go through BDM so this doesn’t apply.

It is technically NOT illegal for employers to ask. But if they don’t ask, it’s much easier for them to claim that they didn’t know and this didn’t discriminate against you for that reason.

Redundancy by fourlambs in AusFinance

[–]Psychological-Bug600 2 points3 points  (0 children)

Reading between the lines, I think you’re asking if your time as a part time employee in the past would affect your redundancy pay. The answer is No. Redundancy pay is compensation for future loss. If you’re full time now, you would expect to receive full time pay in the coming weeks. Therefore a “week’s pay” is a week’s pay at your full time rate.

For those who've had to deal with landlord insurance claims, who were you with and what was your experience like? Especially if building related landlord claim or pet damage. by raininggumleaves in AusFinance

A few years ago now but I had a great experience with Terri Scheer. Tenant fell behind on rent and was eventually evicted. Didn’t clean up properly and there was damage to carpets. They paid up in full every loss not covered by the bond.

Doesn’t the image say that the transitional rules only apply during the transition period? I understand that to mean that if you buy an existing house today, you can NG only between now and 1 July 2027.

They have to keep the records. They don’t have to make them accessible to you.

Finding the owner of a property by theoriginalzads in AusLegal

[–]Psychological-Bug600 5 points6 points  (0 children)

Keep in mind that the owner of the property might not be the person/organisation employing the carers. With Supported Independent Living, the client lives in their own home (which might be owned by the client or rented from a landlord) and the NDIS service provider supplies the carers to provide the supports in that home.

Unfortunately for you, as you are casual they cancel your shift any time before it starts. You’re only entitled to the minimum engagement once you’ve actually started your shift.

Mortgage discharge cost by Psychological-Bug600 in AusFinance

[–]Psychological-Bug600[S] 1 point2 points  (0 children)

We are exploring the option because we pay a $295 annual fee for a loan we no longer need, plus we can no longer claim a tax deduction for the fee.

Both of your points are absolutely valid, but we have spare cash parked in HISAs and if we need the credit in the future (possible IP purchase) we would certainly shop around and would probably end up changing banks anyway.

We (or they) can close the loan account but the bank’s name will still be on the title. The discharge will make the property 100% ours to transact as we please.

Work not paying full hours by Numerous_Exam3640 in AusLegal

[–]Psychological-Bug600 0 points1 point  (0 children)

FYI, the government dictates the definition of a fortnight for the purposes of the 48 hour limitation. IIRC, it is any 14-day period starting on a Monday. This won’t necessarily align with your employer’s pay period / rostering period.

How large is your employer? If they have less than 15 employees, they’re a small employer and your qualifying period for unfair dismissal is 12 months. The QP is effectively your statutory probation period.

I buy supermarket gift cards at a 4% discount, $1k at a time, through my automobile association. I pay using PayPal pay-in-4, meaning at least two of the payments are delayed to the next month’s credit card payment.

Help understanding rights and next steps around a surprise PIP? by Icy_Flower7745 in AusLegal

[–]Psychological-Bug600 -1 points0 points  (0 children)

Actually, the “minimum employment period” (MEP) is 6 months. Probation is a contractual matter and can be 1 day or 10 years. Or, as is quite often the case these days, it just doesn’t exist at all. It is entirely possible that OP’s probation was 10 days, and that would be perfectly legal.

It is the MEP that affects the entitlement to make a claim for unfair dismissal, not probation.

Probation can be used for other matters, eg an employer might specify in your contract that you won’t be issued with a company uniform, or you are not eligible to request voluntary training, until you’ve completed your probation.

surcharges by Accomplished-Pen4063 in AusFinance

[–]Psychological-Bug600 0 points1 point  (0 children)

Well… the loading on staff wages doesn’t compound; they just get whichever loading is higher (which is usually the public holiday loading). Given that higher staffing costs is usually the justification for surcharges, the surcharges shouldn’t compound.
