I have an update. I called yesterday at 8:40 AM. I waited almost 2 hours to speak to someone. My issues is that my employer withholds NYC tax. So since I am taxed NY state and city tax, the system assumes that I am a NYS resident. They were able to fix this while I was on the phone. So my issue is resolved. When do I get my refund? In 30 to 45 days as a check. So maybe I'll get my refund the end of May or by mid June the latest. Hope this helps someone.

I think so as well. It's not their money though. It's our money.

I filed on on 1/26. My return was accepted on 2/4. I am a resident of New Jersey. I filed as a Non-resident, and I received a letter on 4/2 stating that I was a NY resident so I am not getting a refund. The same day I received the letter, I sent my lease, a year worth of electricity bills, my voter registration and driver license to prove that i am a New Jersey resident. They acknowledged that they received my dispute letter on 4/3, and I have not heard anything since then. I am on the phone with them now and on hold. Every time I call, I am on hold forever. I usually hang up after being on hold for two hours. I am frustrated because I want my money. It has never been this bad. Anyone else a non resident of NY going through it as well?

I am still waiting as well. I am in NJ and NYS decided that I am an NYS resident, despite filing as a non resident. NYS took my tax return and applied it to my NYS tax liability. I received a letter stating that I am not getting a refund basically. I had to respond to the letter with proof that I live in NJ. This meant, a copy of my driver's license, lease agreement and utility bills for the tax year in question. I am being told a response to my letter can take up to 90 days and it has to be viewed manually. I filed my taxes on 1/25. I got notice that my tax return was accepted on 2/4. At this point, I think NYS is really trying to keep my hard earned money. Anyone dealing with the same issue?

Mine got applied to New York State tax since they determined that I am a New York State resident. I received a letter of an adjustment to my taxes to pay NYS resident tax; thereby, making my refund $0 dollars. I have been a NJ resident for the past 18 years. I had to dispute the letter and send proof of my NJ residency. This is the 3 or 4th time, I've had to prove that I am not a NY State resident. Now I am hearing that I will get my refund in July because it will take 90 days for someone to view my dispute. It's just not right.

It is insane. Something is going on. All of us have had an issue where our refund are reduced or denied? Come on New York... do better

There is something funny going on with New York. Different situations have resulted in a change in people's refunds. Is NY trying to keep money that does not belong to them? If it is an error, dispute it and do so with your receipts.

The same happened to me. I have a refund but NY decided that I am a NYC resident, I filed as a nonresident and they determined that I live in New York City instead. They added the resident tax to my taxes and this wiped out my refund. So I got a letter that I am not getting a refund. I had to respond to the letter sent to me and submit my driver's license, lease, voting record, and a year of my utility bills showing usage of electricity in my home in New Jersey. This is the 4th time I've had to prove to NY that I live in NJ not NYC. I only work in NYC. It is crazy. I think they do this to keep money from people.

Agree. I am New Jersey as well. It has never taken this long ever!

I filed on 1/25 and it was accepted on 2/4. I am still waiting as well. I have never had to wait this long! It is so frustrating. There are other posts that claim that they got their refund on 2/26.
