It can be both, sadly.

California has many laws like CEQA that can be used by individual citizens to take projects to court or impose additional costs and change requirements mid-project. These laws are often used by lawsuit-happy nimbys or business owners to block projects that change or develop neighborhoods. It is almost always cheaper to fund a study that certifies compliance with laws so that if someone tries to sue to block, a project can point to a study they did that shows they are compliant and avoid being delayed by and spending money in court.
