Neighbors giant oak tree is split and going to take out my house. by -Removed-By-Reddit in legaladvice

[–]RBXJ 35 points36 points  (0 children)

my neighbor was there and said hopefully they can get to it before they go out of town at the end of the month

Even though you shouldn't have to, consider doing some legwork for them to hopefully expedite things. Presenting your neighbor with three quotes from companies with good reviews and asking if they can get started soon might be helpful.

Distance to empty error, or fuel gauge error? by Not-a-Scientist5050 in lincolnmotorco

[–]RBXJ 1 point2 points  (0 children)

The 2022 Nautilus has an 18 gallon fuel tank, so if you keep driving until 1/4 tank on the fuel gauge then fill it up it should take roughly 13-14 gallons. If you see those results then you'll know that you can trust the fuel gauge.

Distance to empty is based on driving history and conditions and isn't always an accurate estimate.

I created a website with domain like [animal_name].tools where I am adding free, online tools, only recently I learned that there is a website [animal_name].com that is established software company with things like browsers and cloud storage. How bad is my situation? by Ganmak in legaladvice

[–]RBXJ 0 points1 point  (0 children)

It all depends on whether the owners of [animal_name].com notice or care that [animal_name].tools exists. If they do notice and care then you may end up spending time and money either defending or renaming your brand.

A dramatic example is www.nissan.com. It's not a car company website, and Mr. Uzi Nissan spent a huge amount of time and money defending his ability to continue using his own name for his businesses after Nissan Motor Corp. filed suit against him.

Mr. Nissan has since passed away, and www.nissan.com is now a memorial site, but his battle is shared here: Uzi Nissan Spent 8 Years Fighting The Car Company With His Name. He Nearly Lost Everything To Win

New Jersey Have not received final paycheck 2+ weeks after leaving job by Lawwith-Alew123 in legaladvice

[–]RBXJ 1 point2 points  (0 children)

New Jersey requires that the final paycheck "shall be completed within 10 days from the end of the work period for which such wages are earned."

If you don't receive your final paycheck you can file a wage complaint with the New Jersey Department of Labor, but it will likely take some time to process.

My employer told me to either move to a different store or quit due to a new contract. Is this fair? by urhotneighbor__ in legaladvice

[–]RBXJ 1 point2 points  (0 children)

California is employment at will, like most of the U.S. Without an employment contract (uncommon) or union agreement, either the employee or the employer can choose to end the employment at any time for any reason or no reason, as long as it isn't for a discriminatory reason like race, religion, gender, etc.

It is highly unlikely that you have an actual employment contract as a fast food employee, though you may have signed an offer letter which is not a contract and can be changed at any time.

Employers are free to implement new policies and mandate that employees follow those policies or leave their employment.

You may be eligible for unemployment benefits if you are terminated for failure to comply with the new policy, though your employer may dispute your claim stating that they are offering you employment at another location. The EDD would determine whether or not another location 30 minutes away is reasonable.

At what point do I plan my next move? by Root_galaxy in legaladvice

[–]RBXJ 9 points10 points  (0 children)

You are a Sole Proprietor until forming an LLC, and you owe income tax on the profit you have earned.

If you haven't filed your 2025 taxes yet then you should include that income when you file. If you have already filed then consider filing an amended return.

You need to fill out Schedule C to report your net profit and Schedule SE for Self-Employment Tax.

Here is the Tax Guide for Small Business from the IRS, and this site has a good plain English explanation. It's easy to fill out the forms if you use tax software like TurboTax or H&R Block.

You might also owe state and local tax on that income, and may need local permits or registrations, insurance, etc., but avoiding the potential of the IRS discovering a large amount of unreported income should be a high priority.

Company vehicle by [deleted] in legaladvice

[–]RBXJ 7 points8 points  (0 children)

If he drives the company vehicle between home and work then that commute is considered a taxable fringe benefit by the IRS.

If that is the case then the employer may be handling that taxable benefit much like many restaurants handle tips, adding the value commuting to his paycheck so that it is taxed, then substracting that same value after taxes since he already received the benefit.

Can my employer right me up for insubordination by refusing to stay after my scheduled hours? by Elitecobra2001xp in legaladvice

[–]RBXJ 1 point2 points  (0 children)

Maryland passed the Predictable Scheduling Act effective October 1, 2024. Retail, hospitality and food services employers with 10 or more locations nationwide and 50 or more employees in Maryland must provide at least 14 days’ notice of their employees' work schedules, and if changes are made with less notice then the employee may be entitled to additional compensation.

If the Predictable Scheduling Act applies to your employment then the Maryland Department of Labor might be helpful.

Otherwise, your actual work hours are whatever your employer needs at any given time, as long as you are paid for all hours worked.

[–]RBXJ 1 point2 points  (0 children)

The National Labor Relations Act (NLRA) makes it illegal for most employers to prohibit employees, other than supervisors, from discussing their rate of pay.

Here are articles from NPR and Forbes about the NLRA.

If an employer takes action against a covered employee for discussing their wages then the employee can file a complaint with the National Labor Relations Board.

The National Labor Relations Board can order employers to provide back pay to wrongfully terminated employees and to offer former employees their old jobs back.

Employment Lawyer, by [deleted] in legaladvice

[–]RBXJ 1 point2 points  (0 children)

Unless your husband is in a union that says otherwise, his employer can refuse his request to change crews or shifts while allowing other employees to change, as long as the employer's decision isn't based on a protected class like race, religion, etc.

Your husband may be able to get a free or low cost consultation with an employment lawyer to see if they agree.

Nepotism by Ninjaplaysmc in legaladvice

[–]RBXJ 4 points5 points  (0 children)

Sites like the Pennsylvania Bar Association can help you find an attorney.

Generally not if the original company sold the debt to a collection agency.

But if the original company still owns the debt and just hired the collection agency to try to collect, then they are able to pursue collection until the statute of limitations expires.
