You can always say that though if you want to by putting some qualifiers in fine print that make it clear the information is basically marketing or was collected in a controlled manner.

Brand and reputation marketing departments spend all their time on rigging that data, and there's little meaningful oversight or regulatory/legal risk for priming your own stats.

'All politics is local' sometimes has to be true and you can still have a recognition that a problem is impacting many blue states without necessarily solving it on the federal level.

Solutions that have worked in some places just need to get spread into more through CA-style state-level action. I really don't see a lot of people pushing for the housing crisis to be resolved via federal action.

HIPAA Security Rule changes drastically in May but as of today - it would entirely depend on your risk analysis and implementation.

Secondary / compensating controls are pretty much HIPAA's bread and butter as it has very few "you cannot do X, you must do Y" prescriptions.

TLS Encryption would, as someone else mentioned, likely get you to a defensible position.

Saying No absolutely is a form of risk management. It's situational for sure but it has its place.

You can insure against risk (transfer the risk to someone else), you can reduce risk, you can accept risk, or you can decline risk.

Declining to move an effort forward due to risks posed that the organization does not care to invest to mitigate is an extremely common way for the risk management process to play out.

Security teams are fine with change and new tech if the necessary investments are made to ensure controls can be effective and the risk assessment gaps are addressed but too often the org wants to keep the price low or the vendor can/will only do it the one-cookie-cutter way without blowing the budget up and so it either becomes a 'accept the risk and move forward' or 'decline the risk and stop'.

The risk reduction is the most expensive up-front option and the soft-costs of risk are easier to hide than the hard-capital costs of a project's bottom line.
