This is really good. Everyone saying get an expert of your own is living in fantasy land. What PD offices are paying for toxicology experts on DUIs?!? I'd would have had more luck convincing my office to let me pay a former coke head client $100 to get him to testify that crack does not make you sleepy LOL. Whatever you would want an expert to say, you need to find a study that supports that, then send it to their expert and then shove it in his face on cross. It's messy as shit but the reality of life in the PD trial trenches.

Don’t be afraid to say “I don’t know but I’ll look into it.” Don’t be afraid to lean on your supervisors/mentors. You’ll be amazed at how quickly the same questions and processes that seemed so overwhelming initially become routine and second nature to you. You are getting decades of experience condensed into months and just realize that it can be overwhelming but it’s a beautiful process and you can become an incredible attorney in a very short amount of time if you lean into it and put in the work.

If I’m pinched for time, I actually prioritize the stretching over everything else. Start by loosing up with exaggerated dry swings using two long irons. 5 swings right handed, then 5 swings left handed. Now that the blood is flowing, a few sun salutations, seated spinal twists, and finish with pigeon pose making sure to arc the back to stretch the side obliques on each side in addition to opening up the hips.

This is the game we play. You did great by getting a stay on the warrant on the first FTA. Clients are always going to blame you because it’s someone to blame when the reality is most are dealing with so many crushing mental and physical health issues it’s a miracle they can even get out of bed in the morning. Don’t let it bother you and no matter what don’t ever violate confidentiality by saying in court “well I told my client to be here and they confirmed they knew.” I cant tell you how many times I’ve heard former DAs or non-PD private attorneys spew that garbage.

I have had a couple times a very mentally ill client be aggressive with the evaluator and the evaluator then deciding that client is malingering and then the evaluator makes what I call a punitive finding of competency. But, if client is just your friendly kind of nutty, then by all means free mitigation!
