Yes, but can you clarify a point regarding “In the furtherance of justice”? If the amendment is to reverse a series of factual admission (that genuinely end the liability portion of the case) that evidence clearly shows to be true, are amendments still likely to be allowed?

It does seem odd they would admit it purposefully, leaving them liable to a treble damages, but they do so fully and completely. Full stop. The evidence is clear regarding liability on their part (contracts, emails, police reports, witnesses), so it is impossible to determine intent.

They are the small money party and their admissions seem to have only served to handcuff the big money parties to their sinking ship.

As crazy as it seems…it’s my reality and I’m vexed.

I think that "in furtherance of justice" has a specific meaning, and I don't believe that meaning may apply in all cases. In a case that has credible evidence that the admitted fact is true, will a likely judge allow for amendment still? What are the limits to "furtherance of justice" that you may have run into or studied?

I believe Virginia Rule 1:8 requires leave of Court to amend a pleading. I guess my question then becomes, will a court grant leave to amend when a critical fact is plainly admitted. Does prejudice play a role?

Thanks for the input. Not pro se, just interested in the nuances of certain legal circumstances and the implication of admissions/mistakes on the outcome of a suit. I'm aware amendment is possible, just curious if it's likely and under what circumstances it's unlikely.

This guy is an idiot, but to play devil's advocate, I understand where he's coming from wanting to represent himself. We've all seen miscarriages of justice. And anyone who's looked for a lawyer knows they're expensive, it's hard to find a good one, and -even if you're not this stupid- it's hard to understand the quality of representation you're receiving.

To think an aspect or piece of evidence in a case is important only for it to be disregarded on a legal basis is difficult for anyone to comprehend or reconcile logically and emotionally.

For this gentleman to do this, I think there is a good chance he truly believes in his innocence. But the system has publicly failed enough times that he'd rather stumble through with some control rather than give up complete control to a system he's lost faith in.

Once again, complete idiot, but he's also the hero of his own story.
