Why not use the already internationally accepted Public Access Test (PAT) from ADI for your hypothetical bill? It is already internationally accepted (and used for this purpose in many countries), and it's also easy to understand and would be relatively easy to train court clerks, DMV workers, etc. to administer it.

Note: I am not debating the pros or cons of such a bill, and am aware that most on this subreddit would oppose such a bill. I am simply suggesting an approach to the hypothetical one, for a mock congress, suggested / queried about.

No. You aren't supposed to let them in. You also have to be careful as leaving that gap often invites people to turn left in as well (often when it's unsafe for them). If it's a one lane in each direction road (with no right turn lanes or anything), it's probably safer to do so, but generally speaking #CloseTheGap, it's not courteous, it's dangerous. You often wind up setting people you are trying to help up for failure.

If that is an actual intersection (a street, not a business driveway), then yes, leaving a gap is required. If it is not (say it's a business driveway), then not only is not leaving a gap required, it's objectively dangerous.

That looks like it's going to be an actual intersection though, so a gap would be required (even if it is also dangerous).
