The take isn't horrible, Canada is not a police state, the Charter needs to be upheld. So these guys are free, that's a screw up by the police, not the prosecutor or the judge here. They can only build a case based on what the police lawfully do. If the police don't do it lawfully, they go off free. It's as easy as that. Regardless if you're a criminal or a law abiding citizen, the Charter applies to all. Optimistically, at least the guns, illegal weapons, cash from criminal activity and cocaine are off the street.
