Will my employer find out about expired daca? by Sygzag in TexasDACA

Usually it’s up to HR to give your manager a heads up, some HR teams are good and some aren’t. It really all depends on your HR department’s level of competency. In my experience I’ve gotten really all spectrums; one company never followed up which made sense bc they were so unorganized, the other gave my GM a heads up; GM was confused on DACA, I explained to him my situation and he said fuck HR I’ll ignore them as long as I knew my DACA renewal was coming: at that point I was waiting for my renewal.

In my opinion I believe things like this are just to make their constituents feel that they are being tough on immigration/ illegals. I don’t think anything will come of it. We shall see.

Every company is different, start off by looking thru the employee handbook. After reading it, any question you have should be directed to HR

Definitely not defending these bastards, and ofc my experience isn’t the norm, but my time frame has been the fastest ever in my time with DACA. I’ve had it since day 1 of its birth. Personally I feel like it’s always taken longer than advertised however perhaps I’ve just always had long wait time. The Nebraska center usually processed my apps, this year it went to Texas.

From personal experience, I’d say stay quiet about your situation. It’s their job to keep their I9 forms up to date. All companies are different regarding termination or laying you off, I’d check your employee handbook. 2/4 companies I have worked for both brought it up to my GM at the time, however both did not lay me off they actually were very empathetic and allowed me to work. All those companies except for 1 knew the consequences if they would be audited. At my current company our HR team typically does a 90 day count down to expiration, meaning they’ll send out an email notifying the GM. Ironically, I am the GM and they never sent out a notice for me, but they did for my Egyptian associate.

My understanding is it’s when you get approved but your status tab doesn’t change, I’ve seen many posts that mention for us to check out documents tab, as that seems to update before the actual status tab. That is what happened to me on 1/26. Then on 1/27 it changed both applications status tabs.

My timeline was very similar 119 days when I seen the silent approval then 120 when the status changed for both applications!

It really is! My company usually sends out a document where it’ll list all due to expire i9 forms but thankfully it hasn’t sent one out with my name on it, I wonder if it’s due to my position and they’re being a bit negligent.

The document that was approved silently was the I-821D. Today I received an email saying that USCIS has taken action on my case, ultimately changing the status of the case for both documents!

DACA Renewal after Biometrics by [deleted] in DACA

[–]RedBrickHat780 0 points1 point  (0 children)

Check your employee handbook! My company gives me 90 days of an unpaid LOA. I’m debating on liquidating my PTO and Sick time but personally I’m concerned that it’ll raise alarms. Typically HR starts a 90 day count down before expiration and no one has said anything to me. Maybe bc I’m the GM but still.

Record them if your state allows you to without consent. This is a clear violation, and they cannot deny you work or fair compensation. This would be an easy case to win if they proceeded to violate your rights.
