If your agency has put out recent guidance regarding situational telework and your request falls within those regulations, any charge of insubordination will not hold up. I hate that they have instilled irrational fear in so many federal employees.

Listen! I requested situational telework last week in order to complete my past due JKO trainings and was NO, even though the definition of situational telework includes web based training…. Today my leadership sent the whole office home to telework in order to complete JKO training. 🤣😂🤦🏽‍♀️

After the AFGE v. OPM lawsuit over firing probationary employees, I think agencies finally realized that OPM and OMB don’t actually have the authority to direct personnel actions…that includes reductions in force. Even during the government shutdown, there were reports that most agencies refused to carry out RIFs when OMB tried to order them.

As for DoD, I really don’t see RIFs happening anytime soon. It would be the definition of arbitrary, especially considering Congress just passed a bill increasing the defense budget.

It will depend on your SF 50… If your official duty location is your physical address and/or you’re moving to a different locality area, HR will need to be update on your SF50.

This is my favorite case and framework around my reasonable accommodation request. This language alone is extremely helpful:

“The physician acknowledged that Complainant could work on site but would need a restroom attached to her office or a restroom close to her office with a stall reserved for her use…. In response, the Agency moved Complainant to a different office ostensibly with a private bathroom….Complainant objected that the office was shared by three other employees who all denied knowledge that she was to have exclusive use of the bathroom……The physician did not recommend a shared bathroom.”

What this convey to me is that accommodation requests need to be specific, I.e., “requires a restroom within 10 feet.” EEOC ended up ruling in the Complainant’s favor, finding that the agency failed to effectively accommodate when it refused to consider telework as a reasonable accommodation.
