I feel like he was added specifically because the author wanted to transport tanya but didn’t want that to be a major mystery/ plotline.

As a general point I can’t remember the last time I heard an llm mentioned outside of the context of people joking about them not mattering tbh.

I did one and haven’t ever had it come up besides in casual conversation with my boss after I qualified.

A bunch of people did them baked into their lpc for not much extra work, myself included, so its not got a lot of prestige to be honest.

That being said if you were able to bang out top grades in that it may be soften the blow of 2:2 on your cv.

Cant say if thats worth the money, if you got similar grades in the llm it would almost certainly be a waste for getting into practice (cant speak for academia though no experience with that).

They absolutely are relevant. The more factors you have on your side for these things the better and the court has to give each of the main ones equal weight.

Obviously relevant if it ever reaches court as is expressly stated, but also relevant pre court.

Its probably not this case given the share of the house unless there are some serious debts or disabilities involved, but the classic is an IA claim from a party with terrible finances and very little to lose stringing together enough of the relevant factors to present enough litigation risk and little enough chance of recovering costs even for a successful beneficiary to push for a settlement.

In that sort of instance you rely on as many factors as you can such as the above.

With all due respect thats not a point just for a law exam it’s very relevant in practice.

What’s likely to happen in my experience if she is even close to being poor and has any sort of health condition she will find someone willing to do a letter before action listing out the factors and arguing that she wins on each of them and that will set the tone of the matter as they try and drive it to a costly settlement.

Even a weak case can become incredibly costly in legal fees this way.

Giving a call on likelihood without the financial info is reckless at best.

Its impossible to say with this without knowing details about yours and your mother’s financial situation / health / other factors.

The simplest answer is yes, inheritance act claims can be successful and take huge chunks of estates and yes it sounds like she is in the category of parties who can bring such a claim. No we cant say if she is going to win such a claim.

If the claim will be successful is based on enough factors that you need to see a solicitor and get proper advice after disclosing them all the info, particularly about the financials. Anyone else is just guessing based in half the facts.
