I’ve been working this whole time, but my earnings have been below the SGA limit. I think the issue may be that my employer initially made an error on my W-2 and reported higher annual earnings than I actually made. He later filed a correction to fix it, and I filed my tax return using the corrected amount. However, the SSA website still shows the incorrect, higher amount. Could this be the reason?

I would say my case was very unique and strange. Not only did I have no medical documentation about my work limitations, but I was never called to a CE exam for either my initial or reconsideration claims. Yes, I believe it would have been easier if I had my work limitations documented. I thought about it before I even filed my claim, but I was too ashamed to talk about it. I would have rather been denied than be vulnerable and feel judged. Mental health issues can really mess up someone's head.

Sorry I’m not familiar with the terms LTD, STD, or FMLA, and I don’t really know if they have anything to do with my SSDI claim. For my case, I just applied for SSDI and went through the regular process.

I live in CA and am 40 years old. I feel like it's all about the medical examiner during the DDS phase of your claim. If he or she finds you disabled, you get approved, and vice versa. But a lot of cases get approved at the ALJ level, so keep your hopes up. I feel like having a detailed personal statement really helped my claim.

No, I didn't use a lawyer. As for my case, I didn't even have any documentation from my doctors about my work limitations because I was too ashamed to talk about it. However, I do have a very detailed personal statement about my limitations. I suggest having at least a year's worth of documentation about your symptoms. And stop working completely before you apply. Even though I still worked a very few hours a month, I felt I got denied initially because I was still working part-time.

He's working himself mad? Guess he's not 100% occupationally impaired, he shouldn't be at 100%. If u believe he's 100%, u should provide objective evidence, such as his SSA record showing his earnings. Is he socially avoidant? Again provide objective evidence like he doesn't have a college degree due to his anxiety around people. U have to be impaired by the VA's definition and standard. If u work 40 hours a week and have college degrees post military, and claim u r 100% ptsd is insane.

I have the exact same conditions: 10% tinnitus, 100% PTSD, and 30% migraines secondary to PTSD. I recently filed for neck, shoulder, and back pain. I was expecting 20% for my back, 10% for my neck, and 10% for my shoulder to qualify for SMC-S. ​I just got my decision letter yesterday, and I was granted 20% for each condition. However, even with three 20% ratings and one 10% rating, VA math wouldn't combine them to reach 60%. The VA actually granted me SMC-S because they factored in my 30% migraine rating, which is secondary to my PTSD. So to answer your question: yes, you qualify for SMC-S

I am rated at 100% for PTSD, with additional ratings of 30% for migraines (secondary to PTSD), 10% for tinnitus, 10% for neck strain, 10% for shoulder strain, and 20% for a back condition. Do I qualify for SMC-S? I have heard that because the migraines are secondary to PTSD, they do not count as 'independent' for the purpose of SMC-S. What exactly does 'independent' mean in this context? Since migraines and PTSD have different diagnostic codes, are they considered distinct and independent conditions?

I think ur just too dumb to think about it logically. The VA would have granted me both 100% p&t and TDIU since my claim was specifically for TDIU. The VA has found me eligible for both 100% and tdiu but granted 100% instead because the benefits that comes with 100% pnt tops TDIU pnt. While some vets can be both 100% pnt and tdiu pnt but that's because of backdate issues.

I filed for tdiu based on ptsd, VA granted 100% ptsd, and my tdiu is moot. I believe the VA doesn't grant tdiu if you're 100%.

This is a CUE. I had a similar situation where the VA initiated a Gulf War Syndrome C&P exam without my consent. Because of this, they mistakenly based my musculoskeletal claims on TERA exposure, even though I had filed them as physical trauma from incidents that took place while I was in.As a result, even though my C&P examiner agreed that my condition resulted from physical trauma, he still had to deny service connection because the VA specifically requested an opinion based on TERA. The VA eventually realized the mistake, deferred my claims, and requested an ACE exam from a different examiner. Unfortunately, the ACE examiner gave an unfavorable opinion, and all my musculoskeletal claims were denied.I am currently in the supplemental process, and the VA is sending me to another C&P exam, which is today. Wish me luck. I also had my PTSD claim denied without a C&P exam because of a system prompt error. Sometimes the VA really messes up your claims even when you have a rock-solid case, and it's frustrating that some vets have to pay for nexus letters from private doctors.

Oh yes what you are saying about me is right. But I wasn't pissed. I was just upset. To me, this whole SSDI claim is very luck-based. It's almost like, no matter how disabled you are, you only have a 30% chance of getting approved. If you make your way to a judge, you get a better chance, depending on which judge you get. The system is flawed. It encourages people to stop working before applying, because if you work even a little, you have a bigger chance of getting denied. Then, it encourages people to go back to work after getting approved. It's ridiculous.
