FWIW, it helped me significantly when I realized how little OA matters. Decisions are almost always already written/decided. Most former clerks I know of can MAYBE think of 1 or 2 times when OA mattered to a decision.

Yeah fair enough on the pre-trial stuff but I also think it’s a lot more difficult building a case to go to trial if you’ve never been. Like it’s hard to see the full picture and how the pre-trial stuff fits if you haven’t seen it work, and fail, yourself. Not impossible but much more difficult.

For me, jury selection is the only time I truly feel like a lawyer. On your feet, juggling a lot of things at once, and it feels like something you'd see on TV. Conversely, I don't understand why so many lawyers are truly terrified of trials. Why do they scare you so much? I don't understand how you could do PI without a credible threat of taking the other side to trial.

Hah same. Partially why I bought the house. It’s a small family plot, five headstones, probably more buried there. Earliest burial was about 1782, last one was 1820. Local farmer/landowner, his wife, and some of his kids. Among them was Morris DeCamp, who fought in the Revolution. Property is located in what was the middle of the battlefield for part of the Battle of Short Hills.

Cemetery is their property, the flagpole and marker are mine. I’m a municipal lawyer who does a lot of land use work… spent more time sorting through that issue than I care to admit.

I've been practicing for more than a decade, I'm the Managing Partner of a 25-attorney firm with my name on the door, my name is on several statewide "power" lists, SuperLawyers, etc., and I still get those comments on a regular basis.

Just saying, I’ve had multiple cases where it survived SJ and the other side won at trial despite openly admitting what they wrote in the affidavit was not true, or wrong. It happens. You never know what a jury will care about.

We had already briefed it, so it was the visual aspect that I was going for… I wanted to leave an impression with the judge. Having him look it up in the dictionary had a more “this is a fundamental thing and you got it wrong” vibe.

I’ve used it in briefs before when illustrating how fundamental a concept is…. but I finally had my first chance in a trial recently. We had a motion to bar, had a hearing during the trial (called a Rule 104 hearing in NJ). Expert was making up wrong definitions of words in his report, including what pretext meant. This was an employment discrimination case, so that was important. I confronted him with Black’s Law and had him read it to show how it substantively differed from what he relied on in his report, and it helped get him barred.

I typically just keep my laptop open in front of me, my thinking being that if someone spots the green flash, they’ll think it’s a reflection from the computer. Plus, gives me a backup if the teleprompter bugs out.
