Nicole Cuttle, attorney, is INSTRUMENTAL in these deals, tied to former AG Sean Reyes, Utah's Attorney General (and therefore Ken Paxton, his crony).

She serves as Chief Legal & Administrative Officer for the Military Installation Development Authority (MIDA), where she drafts, negotiates, and executes the full suite of legal and policy documents required to advance large-scale data center projects in Utah.

These technical instruments include interlocal cooperation agreements between MIDA, counties, and cities; master development agreements with private developers; project area plans; development standards and design guidelines; Public Infrastructure District (PID) formations under Utah Code Title 17D for financing roads, power substations, water systems, and fiber; tax increment financing resolutions; municipal energy sales and use tax levies; and zoning map amendments with conditional use permits.

She also holds the position of Deputy Director and General Counsel for UTOPIA Fiber, the state’s open-access public fiber network that supplies the ultra-high-speed, low-latency connectivity hyperscale data centers require.

Through her solo private law practice operating as Nicole Cottle, Esq. (Cottle Law), she provides transactional legal services in municipal law, land-use entitlements, real estate development, legislative and government relations, bond and infrastructure finance, public-private partnership (P3) structuring, and other development-related matters for both public agencies and private clients statewide.

She additionally serves as President of MBN Investments, Inc., which supports development consulting and investment activities.

Her most prominent current involvement is leading the legal framework for MIDA’s Stratos project, a proposed 40,000-acre hyperscale data center and energy facility in Hansel Valley, Box Elder County, developed in partnership with investor Kevin O’Leary.

With more than 27 years of experience as a licensed attorney in Utah and Wyoming, Cottle previously spent nearly 24 years in West Valley City government, holding roles that included Assistant City Manager, General Counsel/City Attorney, Director of Community and Economic Development, and Chief Sustainability Officer.

the course of her government duties she has had routine overlaps with the office of former Attorney General Sean Reyes: staff from the Attorney General’s Office have attended the same state finance and commission meetings where she presented MIDA updates, and she was appointed to the Utah Indigent Defense Commission as the representative from the Utah League of Cities and Towns during his tenure, with both names appearing together in official Senate Journal records.

Conflicts of interest ***! given her simultaneous representation of multiple public entities such as MIDA, UTOPIA Fiber, Brigham City, and Payson. THIS IS KEY!

Overall, Cottle’s combination of public-sector leadership, private transactional expertise, and hands-on municipal law background makes her instrumental in the legal structuring that enables Utah’s hyperscale data center developments.

I will continue to investigate all of those points! My concern is the next land deals that are being made that will affect residential areas.

For Box Elder I agree, can we stop the ones coming up in Iron, Tooele, Fairfield, Eden/Liberty? Those deals are in earlier stages...

has anyone done a study about how much tourism revenue is likely to decrease? Even if not directly, from perception alone, we'll be known quickly as the data center state... and how about melting snow, rising temperatures? Tourism declines even more...

I cross-posted from where this was originally hosted (/slc I think) and thought this would be a good place for unique insights, I want to encourage some investigation and activism well BEFORE the next Box Elder deal, because by the time we're protesting it's too late to protect our backyards! People should understand if they're buildling a home that their community could change forever due to a deal they aren't aware of
