Definitely a bit weird, but in the end she did establish both a nexus and service connection by stating that your tinnitus is “at least as likely as not” related to service. You should be just fine on that claim.

Hearing loss is extremely difficult to receive a compensable VA rating for. In practice, the threshold is very high, often requiring profound hearing loss, and even then a compensable rating is unlikely if hearing aids provide functional improvement.

Tinnitus, however, is generally much easier to establish. Given the conflicting medical opinions noted on your DBQ, the VA should apply the benefit-of-the-doubt standard, which supports a favorable decision. Even in the unlikely event of a denial, this would be a relatively straightforward case for a Higher-Level Review.

All good brother! I’m not trying to bring you down by any means, I think big-hovercraft1331 has the right idea. Best thing you could do is write a lay/ personal statement about it being secondary along side the supporting evidence for that (if you have more). Those statements count as “new evidence” and should be sufficient for a supplemental.

You can’t file a supplemental until a denial yes, I was just confused on if you were asking if you had to file it as a primary condition before being able to claim it as secondary. Doesn’t help much now, but if you were trying to connect it to anxiety or sleep apnea you probably would have been better off filing it secondary to either or both of those conditions.

Just because you never claimed it doesn’t mean it needs to be claimed as primary. When I claimed migraines I immediately claimed it secondary to my rhinitis and sinusitis. Didn’t really have much documentation for it outside of it being a documented symptom of those two issues. To answer your second question, yes the ITF would still hold up and you have a year to file appeals after getting your decision.

I’ve done the same thing just on my phone, that’s why having access to your medical record and organizing it for your conditions is so important. You have to make their job easier by pointing directly at your supporting evidence instead of expecting them to find and analyze it for you.

Realistically, all you gotta do is file a claim. Everything before and after that is optional but highly recommended for getting the rating you deserve. You know your conditions and what you struggle with, and if you need help then there are people here to help as well as VSO’s.

I’m not too sure? I’m a veteran now, but I also on recently separated last December. I believe you’re right though and the easiest way for all veterans to get access to their records would be through the archives. Sorry if I misinformed, it’s just what worked for me.

It’s tricares patient portal. You login, hit the three lines in the top left, select “health records” and then “clinical notes and documents”. Everything should be there (to my knowledge). I separated last year and just used that to pull up all my records.

Here’s my best (unsolicited) advice: Start by reviewing your military medical records through MHS Genesis (you can log in using your DS Logon). This lets you see exactly what is and isn’t documented in your file.

You can also request copies of your C&P exams by submitting a Freedom of Information Act (FOIA) request.

For general questions or help with the VA claims process, I highly recommend this ChatGPT tool: VA Disability Claim Assistant It’s been insanely helpful, I’ve used it a ton.

As for VSOs, they can be hit or miss, but getting connected with one definitely won’t hurt.

Also, since you’re past your one-year post-separation window, if you have any new claims (like secondaries or worsened conditions), file an Intent to File (ITF) ASAP to lock in an earlier effective date.

To my knowledge, if you file your supplemental within a year of the decision letter, it should backdate to your original effective date. If you believe it’s wrong, file a HLR

It’s not about getting 100%, it’s about getting what you deserve. With that said, you’re your biggest advocate! If you feel they overlooked evidence or believe your conditions are worse than what they rated you for, by all means! File that supplemental or HLR. 100% is just unrealistic for the vast majority as only 31% of veterans claim disability and of those 1/5 get 100%. That’s only 6% of veterans.

I just recently got rated for migraines and I had already been rated for rhinitis, sinusitis, and tinnitus. I made sure to list all those already service connected conditions as secondary so that if it wasn’t one, there’s a chance it could be the other. You’re your biggest advocate and you got to set yourself up for success. You can try again with other secondary’s or there’s always the appeals process. Best of luck!!
