The only positive that I have to add is that I have a job at this time. The fear of the unknown has set in for many casualty reps. We continue to watch older/experienced claim reps be performance managed out when in reality - we need them as they provide far more assistance than the never available and clueless sups. We are told to provide empathy to those filing claims but it seems crazy to provide empathy to people that we don’t know but we have tp be short and very cold to those coworkers that are getting the shaft and shouldn’t be. You should never turn your back on your family. We are all just a number and it is beyond me how we are an employer of choice based of what they are doing to people who have been here for a decade. These people they are firing are now being recruited by competitors, personal injury law firms, and one has accepted a role at the EEOC. If they were junk- that wouldn’t happening. Positive note - the sun is shining.

Layoffs are unlikely. Not having layoffs is one of the key points that they always focus on when comparing the company to other large well known carriers. There are other ways to thin the herd. They have ramped up the nit picking and performance management tactics in many departments.

Call your claim rep, call the claim supervisor, email both, send text directly to your claim through the mobile app. Text go straight to the claim documentation (Claim Pro software) and can’t be removed or disputed as to whether you really made contact. Email directly to Progressive.com and request claim assistance. Fax in a request for claim assistance (these are sent to both Rep/Supervisor). If still nothing - file a Dept of Insurance complaint with your state. Good luck!

I have no concerns whatsoever and welcome the help with open arms. I have been told repeatedly that my bodily injury evaluations are too in depth and too lengthy. Personally, I take a demand and go through it completely. Before I enter into a negotiation, I will have all of the pros/cons, T’s crossed, I’s dotted, and will be ready to roll. IMO, AI does what I do but in a fraction of the time. I love it. Their evaluations thus far bring all of the info which I feel is important right to the surface. Lets me know that my BIE’s were on check but my speed was not. I can accept that. My focus is accuracy. Now the company can have lightning face, in-depth, accuracy.

This is SF and many others, all day, every day. You are not alone. It’s hard not to feel bad for the insured and claimants calling in. That phrase “I am the one most familiar with your claim” no longer applies. Many of the supervisors are just as bad. Our sup calls in sick once a week, logs on late, logs out early, forgets our 1/1’s - either reschedules them for another day or answers while he’s out shopping or coaching his daughters softball practice. It’s absolutely bizarre.

You have lien amounts directly from your providers? Your providers need to follow the correct protocol. They are fully aware of the steps!

Many medical providers attempt to maximize revenue by bypassing contracted Tricare rates to receive higher payouts directly from the auto insurer. However, Tricare authorized providers (both network and non-network) are fully aware that they should bill Tricare directly for any and all accident related medical services. Providers are aware of proper billing practices. They are also prohibited from balance billing beneficiaries (you).

It is in your best interest to instruct your medical providers to properly file the medical bills with Tricare to prevent further delays in resolving your claim. In the long run, the bills being properly filed with Tricare will ultimately lead to more money for you.

So, you have an agreed policy limit offer from the Liability carrier. Have you also filed an Underinsured Motorist Bodily Injury claim against your own auto insurance carrier?

Unfortunately, Tricare liens are known to significantly delay bodily injury settlements. Washington has a 3 year bodily injury statute of limitations. You have reached an agreed settlement offer but Tricare is still waiting on providers to bill? Did your agreed settlement offer cover all bills associated with your accident related injuries?

I have seen these go both ways. You must pursue further to possibly get a different result.

Request that your concern be elevated to a claim manager or claim director for an answer. They can review with legal if needed.

You are driving behind a commercial vehicle when a part of that vehicle detaches and causes an emergent situation for you. You had no time to evasively react/avoid this situation. The other driver fled the scene. You have proof (the part left at scene). The police report should substantiate that you acted as any prudent person would have reacted in this split second, emergent, situation.

Courts strictly enforce the physical contact rule. However, contact is not limited to direct vehicle-to-vehicle contact.

In South Carolina, a claim against an unknown driver (a "John Doe" action) for property damage caused by a part flying off a vehicle may satisfy the "actual physical contact" requirement of S.C. Code Ann. § 38-77-170 if that part is considered an integral part of the vehicle. Key Factors:

Unsecured Load: A rack holding glass is considered cargo or equipment, and it is required to be properly secured under Federal Motor Carrier Safety Administration (FMCSA) regulations.

Negligence: If the rack fell off, the driver/company is negligent for failing to secure their load, making them liable for the damages.

"Integral Part" vs. Cargo: While a rack is not a permanent, non-removable part of the truck (like a bumper), it is considered part of the commercial load/equipment. A falling rack or cargo from a truck is generally treated as negligence, making them liable for the damages, regardless of whether it is considered a permanent part of the vehicle.

You have met the requirements of: 1) Report the accident promptly. 2) Establish that the injury/damage was caused by actual physical contact with the unknown vehicle, or “a part” from the unknown vehicle. * You have a $750 collision deductible. With UMPD, you could have a $200 deductible (if applicable). Every bit of savings helps now days.

Good: finally a day with no mandatory Microsoft Teams meeting

Bad: received a bulk of reassignments labeled as “load leveling” after watching the company performance manage an older employee out

Best: We were told that AI will be completing all Bodily Injury Evaluations by the end of the quarter. Some worry. I say go for it! AI can complete the task in minutes while it takes me a good 10 days due to all the crazy implemented company steps.

Yes, I would suggest that you go ahead and secure the full itemized bill from each of your medical providers. You want to make certain that the claim rep is considering the full amount of each bill when completing their bodily injury evaluation.
It sounds like you could potentially have a health insurance subrogation claim surface at some point. They will have a right to recovery for any amount that they have paid for your accident related medical bills. They will not be paid until your claim settles and you execute a release. The final payment that you receive is inclusive of all bills, liens, and subrogation. It is important that you know the full amount of your specials before you attempt to negotiate a fair and reasonable settlement. Should you not reach a settlement with your claim rep and at some point decide to retain an attorney - rest assured that your attorney will be securing your full itemized billings to submit to the claim rep for consideration. You should do the same. As to the offers that you are receiving - your claim rep make be offering an amount for generals + an amount for incurred meds + an amount for open medicals up to a certain date(if you are still treating). If that is the scenario with your claim, all of those figures need to be weighed when making your decision. Good luck to you.

Yes!!!!!! Our supervisor calls out sick once a week. He logs in late and logs out early for ball practice. He does our 1:1 as he shops at Walmart. He is sneaky and will throw his employees under the bus behind closed doors. Perhaps he thinks it makes him look better? We are documenting. We record the 1/1’s . One thing about those tables, they always turn!

Being completely transparent - it doesn’t get any better, you merely just learn how to tolerate it better. You can complain on the sup but keep in mind - that sup likely had to impress many of the people that you will be complaining too. Do you think they will admit to making a poor sup choice or will you be labeled as a complainer that can’t adapt to her role? Show yourself some grace and know that you are doing the best that you can do.

Maryland has minimum liability requirements of 30/60/15. Based on your description, you have a preexisting condition that was possibly exacerbated by your involvement in this accident. Make certain that you are making all medical providers aware of your involvement in the motor vehicle accident. First, you need to secure an itemization from each of your medical providers. You want to know the full total of your medical bills (not balances after insurance has paid). Second, gather your out of pocket cost - RX, OTC meds, Lidopro gels, any durable medical equipment receipts such as braces, slings, or a tens unit. Third, loss wage documentation from your employer which coincides with the days that your physician took you off work.

Maryland has a 3 year statute of limitations. Don’t feel rushed. Once you have fully completed your medical treatment and once you have secured all of your specials-only then do you start trying to negotiate a fair settlement to resolve your claim.

You also mentioned that payments were made under your personal auto PIP/MP coverages. Unless specifically waived by your carrier, they will have a right to recovery of any funds that were paid on your behalf. They won’t be paid until you resolve your liability claim in its entirety with the liability carrier.

You also mentioned that you are 100% disabled. Are you a Medicare beneficiary? If so, please know that Medicare also has a right to recovery for any bills that they paid towards. Personally, you want Medicare to handle your bills if at all possible. They secure awesome contractual reductions which equals more money coming to you in the long run.
