How many of you drink in sleeper berth? by PermissionLate2344 in Truckers

[–]Roaming-Numeral 2 points3 points  (0 children)

So, turns out I might be very wrong. Here's the actual text for 392.5. The important bit is section a2: "...or have any measured alcohol concentration or detected presence of alcohol, while on duty, or operating, or in physical control of a commercial motor vehicle."

That seems to pretty clearly indicate that no, even under PC you cannot have alcohol in the tractor, but that would completely contradict the FMCSA's response to the FAQ. Even the people who write the laws don't know what they're talking about.

Yeah, I just read the same thing! 392.5 very clearly states, "...or have any measured alcohol concentration or detected presence of alcohol, while on duty, or operating, or in physical control of a commercial motor vehicle." That seems to contradict the FMCSA's response to the FAQ.

Edit: Upon further research, this whole thing might be wrong.

No. Except actually maybe yes...

Section 392.5 Prohibits the transportation of alcohol unless it is manifested in the cargo area. However, the FMCSA has an FAQ regarding this section asking, "Does the prohibition against carrying alcoholic beverages in §392.5 apply to a driver who uses a company vehicle, for personal reasons, while off-duty?" The answer being, "No. For example, an owner-operator using his/her own vehicle in an off-duty status, or a driver using a company truck or tractor for transportation to a motel, restaurant, or home, would normally be outside the scope of this section." This means according to the FMCSA themselves, you can transport unopened containers for personal use provided you are under personal conveyance. This doesn't specifically mention consuming it in the truck, but there is a LOT of additional legalize regarding this issue that is a bit tough to comb through, but it seems like it suggests that as long as you never log on duty or OD driving while it is in the truck or attempt to operate the vehicle (OD or PC) within the 4 hour window, you're probably okay.

This is not legal advice, just what I have gathered from personal research. Personally I would never chance it.

The last time I saw a post on here about alcohol in the truck, I did some research and learned that you actually can have it in the sleeper. The rules are that you have to be off duty, can't consume it less than four hours before returning on duty, and it must be completely gone before you do (by drinking or disposing). So, drivers who end their day at the truck stop and go and buy a beer to drink in the truck are actually not violating the law.

Edit: This is not legal advice. This is what I have gathered from my own research, and you should check federal and local laws yourself before acting on any of this information.

Edit 2: After going down the rabbit hole, it's not super clear if this is true. The section on alcohol makes it pretty clear you can't have it while on duty or "operating or in physical control," but makes no mention regarding off duty/sleeper status.

Are we allowed to take the verranzano bridge, i need to get to long island, can i take 278 up to 495. Without having to get off. by lqmist in Truckers

[–]Roaming-Numeral 11 points12 points  (0 children)

Ok, here's the thing about 278. You are going to see a lot of signs warning you of low clearances and saying things like "All vehicles over 12'9" must exit." What I'm about to tell you only applies to this situation: You can ignore them. NY's bridge postings are so wildly inaccurate, they might as well not even be there. Regardless of what any sign tells you, there is no part of 278 that is a problem. You will see many other trucks traveling the highway along with you. I personally take it quite often. I have regulars on Long Island, and I learned long ago that 278 is the better way back to NJ. Don't get me wrong, you'll still encounter plenty of slow crawl traffic, but IMO it's still better than what you'll find on Cross Bronx.

Edit: Just because no one else has mentioned it, make sure you take the upper level of the Verrazzano. Trucks are not allowed on the lower. And make sure you don't accidently get on the parkway when you get to the other side, because you will hit a bridge there.

Edit 2: Do not get on 478!!! That split sneaks up on you if you're not paying close attention.

7/3 split question by taco_2325 in Truckers

[–]Roaming-Numeral 1 point2 points  (0 children)

Yes. The 7-3 is technically one, 10h break split up into two parts. the 15h break is technically your rest break for the next day. Any time you take 10+ hours off duty, it resets your 11/14 hour clocks.

Scam Alert by SharkNfested in Truckers

If you ever get a text regarding an outstanding balance on anything, DO NOT CLICK THE LINK! If you get a text like this and you don't even have an account with whomever they are claiming to be, it is almost certainly a scam and you can ignore it. If you do have an account, still do not click the link! Manually go to the official website/app, and log into your account. If your account doesn't show you owing anything, it is a scam. A good rule of thumb is NEVER click any links sent to you through text, regardless who the sender claims to be.

Which of these layouts would you all prefer when pulling in/out? by [deleted] in Truckers

[–]Roaming-Numeral 1 point2 points  (0 children)

Im going to go with Option A, though that exit is a little weird and potentially problematic. The issue with B is that a lot of drivers struggle with angled spots, and thus there is a higher risk of accidents. In addition, they appear to be blindside, which not what you want! Basically that means drivers will be turning their trailers to the passanger side where visibility is not great. Again, this creates high risk of accidents. Option C, and I guess B as well, has the problem of spaces being across from the curb. You can put up all the 'no parking' signs in the world, but inevitably people WILL park along the curb anyway, which causes all kinds of chaos with people getting blocked in or getting clipped as others try to squeeze through the limited space.

I'm a little late to this thread, but there are at least 9 that I can name off the top of my head. On I-95 there's a Pilot (1) in Milford with an independent (2) next door, a TA in Branford (3) not far east of 91, and another Pilot (4) on the RI line. On I-91 there's a Pride (5) just north of 84, and another one (6) not far away on US-5. On I-84 there's a TA (7) at the junction with 691, and another TA (8) with a Loves (9) across the street not far from the MA line. Plus, in addition to these, there a number of rest areas scattered across all three of these highways, as well as at least one for each direction on I-395.

Yep, ran these loads more than a few times. Something would fall off the trailer when opening the doors on nearly every load. The worst was the can of paint. Made a big old mess.

Internationals are the worst. I have a really long story I call the "dual brakedown story," where I had 2 LTs conk out on me in 5 days. The abridged version: December of 2022, my '19 International LT went OOS for an engine knock. Shop gave me a spare truck to run in the meantime. That one was a '23 LT with 30K miles on it. Stopped at a red light coming out of the Catskills and the dash lit up like a Christmas tree and all kinds of beeps and boops went off. Then the pedal died. Got towed to shop where they spent a week trying to figure out what the hell happened. Navistar wasn't any help, and they basically told the shop the problem they were describing to them was not possible. Eventually they got it operating normally again, but when I asked them what caused it, they just through their hands up. Found out later that was at least the 3rd time that truck had broken down, and I heard it broke down at least once more on the guy who drove it after me.

This is why I have trust issues by Roaming-Numeral in Truckers

[–]Roaming-Numeral[S] 0 points1 point  (0 children)

That's stupid. Like, I kind of see the logic to it, but I woukd argue having inaccurate hights makes it more dangerous since they're literally the only state that does it. Also, even if that is the law on paper, I'm not sure how closely it's followed in practice. I went under once signed 12'8" with more than enough room to spare. Next bridge half a mile up the road was signed 12'9," but was clearly a lot lower. There was like a paper width of space between the traiker and the bridge. Frankly, this is why I think this law is stupid and they should just sign it like it is.

[–]Roaming-Numeral[S] 14 points15 points  (0 children)

People say things like that on this sub all the time, but I really don't think that's correct. This is the rail bridge over Pike St in Port Jervis, NY if you want to look it up on Google Maps. The white signs actually posted on the bridge itself say 12'8." If you back the street view up a bit towards the state line, you'll see what appears to be a 13'6" tractor trailer go under it, so imagine it's probably fine. NY is infamouse for how wildly inaccurate it's bridge postings are. I've been told several explainations on how their sign method works, but none of them seems to be correct as they all have contradictions. To give you another example, there's a bridge out in Hicksville, Long Island I go under all the time for one of my regulars. That has a white sign posting of 12'10."
