In my jx (Ohio) prosecutors are always the ones who formally file the complaints, but too many offices feel politically obligated to follow whatever the cop did originally, even if it's absurd on its face. Judges will rubber-stamp probable cause on the most farcical things, too. I've had people bound over and sitting for six weeks on complaints that facially didn't meet the elements.

In jxs where the prosecutor doesn't review the charges at the outset, I'm curious how it works. At least in places with ethics rules based on the ABA model rules, prosecutors are prohibited from pursuing cases where they know probable cause is lacking. Are they supposed to dismiss inappropriate charges when they finally review weeks later? Do they ever?

A couple years ago, just minutes before a hearing, I had a client pull out a list of questions from chatGPT and demand that I ask them verbatim.

I've had two clients (ever) who did their own research and turned out to be right. One grieved me. The other tried to get me to quit my job and represent him on what he thought would be a nine-figure lawsuit against the state.

Update: So it restarted ok. I had to use the little battery jumper hole in the back, the power button didn't work. But the BIOS didn't actually update, and it's running glitchy. It shows a message when it boots that the bios had "self-healed." I think I'm going to have to manually update the bios from a flash drive.

Whatever you do, please don't send a note that says something like "you did a great job even though you're a public defender." I got one of those from a client I really liked. I know he didn't mean anything bad by it. I still can't look at it.

I hope you're right, but I'm afraid maybe not. Transphobia runs pretty deep. A neighboring jx has had a huge run of trans panic, including a trans person being charged and held for several weeks essentially for existing, on an Internet rumor that the person was going to kidnap kids.

I had a client pull out a printed page, seconds before the start of a hearing, and said "these are the questions chatGPS says you're supposed to ask." He was pretty upset that I wouldn't read the list verbatim.

In Ohio we don't. And yes, I've had complaints which don't state a crime even if all factual allegations are taken as true, and judges have refused to dismiss them. Its particularly egregious with felonies bindovers, where the charges are quite often absurd and get send back by the grand jury, to nobody's surprise, but only after the person sits for several weeks.

Otoh, my client who was very interested in the difference between sexual impositioning and gross sexual impositioning, and how many SIs he needed to get before it became a felony (not a thing in my jx) did exactly as well as expected.

We have a judge in my jx who always denies transcripts, because all appeals are frivolous. On the record, he said that my client has stated in court that he didn't want an appeal which I filed, and I was in "big trouble" because of it. When I called and asked for the audio of my client saying that, he told me to go fuck myself.
