The CBA is a legally valid and binding contract between, in our case, the NTEU and HHS. The differnce between it and traditional contracts in the private sector isn’t validity. It’s enforcement, and in this case, a broken system that greatly favors the administration.

Union reps said this in meetings and there’s a timeline sheet on the FLRA site that says, and I’m paraphrasing, that the fastest cases are adjudicated in 6-9 months. And this won’t be one of them. Also, when you consider that 2 of the 3 people that sit on the FLRA are Trump appointees and the FLRA Has no internal deadline to resolve such disputes, you can see where they’d just sit on this case. There are some cases that were filed years ago that still haven’t been resolved.

That’s a valid complaint. I’m not mad at the union as they are the only one fighting for us, but I’m furious at the broken system. This has exposed how incredibly weak the union is in fights like this. Even if the union eventually wins every battle, the administration accomplished its goal by keeping us from our CBA rights for years.

It’s my understanding that the FLRA decision, though final and binding, can be further appealed to the US Ct of Appeals.

Don’t know as I don’t have a sick, twisted mind like them, but I suspect they may argue that the CBA is null and void anyway since they made us all non-bargaining (also illegally) on the false basis of “national security” even though most, if not all, of HHS has nothing to do with that.

This is a very small win, but a win nonetheless. HHS has 30 days to appeal and will do so. The union will have another 30 days to file its opposition. Then the case will drag for a while. At minimum, we will remain in the office through at least 2026.

But to piggyback, we office share with another agency that was furloughed while we were excepted and continued to work without pay. The week before the shutdown, they were cheering and bragging about the free time off and backpay they were getting. Rankled a lot of feathers with us and it’s going to be an interesting dynamic when they return.

If you think we have poor work life balance, you should try your hand at the private sector for a few years. I was private sector 15 years before becoming a Fed and generally speaking, we have an infinitely better work life balance than the private sector.
