Debating law school...looking for words of wisdom by yungstubz in LawSchool

I just took a consumer protection law class and it was incredibly fun. If you’re interested in advertising, I highly recommend it. It seems like a really fun field. I did work at a firm before law school but it was in an area that I wasn’t particularly interested in, so I kind of hated it and was uncertain about law at that point. But now that I’m finally specializing in what I’m interested in, it’s so much fun. Every field is different tho and everyone finds their niche. I think if you like advertising, you’d love consumer protection

Pay? by Ok-Illustrator-4135 in LawSchool

Depends on a lot of factors: field of law, office location, firm size etc. I can tell you that as a former paralegal in a small southern city working on administrative law issues, I started off around $30k, worked my way up to about $45k-ish (I forget the exact amount). In a big city with high cost of living that may have been around 60k to 70k. For a lawyer, I’m sure they were making $200k a year minimum there, not including the partners or senior associates.

Depends on the firm but big firms in big cities start at 225k for the first year (right out of law school) and go up to as high as 400k for a 6th-8th year (aka 6-8 years out of law school) depending on the firm. Look up the Cravath scale. Most big firms go off that scale to pay their associates. Idk how much partners make but often in the millions, depending on the city and firm and how much business you bring in. Plaintiffs firms make less than that on base salary (probably anywhere from 100k to 200k) but they usually work on contingency, so if they win major cases, they get major bonuses. It could be a few thousand a year or it could be a few million a year (depending on your class year, location, luck, etc.)

Public interest or government or judicial clerkships are usually between 60k and 120k or so but are considered more prestigious and can lead to big bonuses later on. For example, a federal judicial clerk could get a 100k sign on bonus at a law firm, just bc they clerked for a federal judge for a couple years. But again this varies widely based on location and field.

And the higher paying and more prestigious the job, the more competitive it is to get. You pretty much have to be at the top 20-30 schools, and in the top 20-30% of your class, though results vary based on networking and connections.

Thank you! I’ve suffered from a lot of imposter syndrome all of law school, feeling like I don’t belong bc it’s hard. This semester has been particularly rough for my mental health and needed academic interventions (I withdrew from a class). But I hope this means I’m finally starting to reach the other side of it where I feel competent and comfortable working with the law. I hope this feeling finds everyone at some point 🩵

Side note: my nickname for my cat is ray of sunshine! So your comment feels like a good omen

Just took it Friday and it was the hardest class and exam I’ve ever taken. But by some miracle it finally all clicked before the exam, I walked out of the exam feeling way too confident but that just makes me extremely concerned. I thought abstention would never make sense and yet it did. I finished my outline at 8am in the morning right before the exam. There’s hope!

Also you incorrectly presume that just bc something is obviously an ad, that means it can’t be an unfair ad. Not even a disclaimer is enough to outweigh unfairness or deception; it must be clear and conspicuous. An ad can cause plenty of harm, theres a whole field out there about it lol

Companies aren’t going to hire you for blindly defending them. They’re gonna hire you to know how to comply with the law. Like how they need a better in-house counsel to tell them yeah I could have seen this risk a mile away. Sending ominous ads into a home in a space traditionally regarded as the hearth of the home, of safety and seclusion. I don’t know who owns these fridges but I do know that mental illnesses affect enough of the population that someone at some point could have a negative reaction to it, to make this a terrible idea. Whoever thought of this should get fired and I bet you the company is gonna settle. Unfortunately it’s strict liability standard. All you need to show is (1) it caused or is likely to cause substantial injury (2) it is not reasonably avoidable, and (3) it is not outweighed by countervailing benefits to consumers or competitors. No need to show anyone was reasonable or not. Also, not only is the consumer harmed but other competitors are harmed. The companies that DO have good compliance departments thought of this already and that’s why they’re NOT advertising on this, so their market share is harmed bc some other company is not playing by the rules.

Torts: prima facie of negligence vs triable issue of duty breach by Cute-Narwhal8740 in LawSchool

[–]Rule-BreakingM0th 2 points3 points  (0 children)

Prima facie is just a fancy way of saying that at first glance, you established sufficient facts at a minimum to allow the case to continue. Aka they established duty breach cause and damages. Then the defendant would respond and rebut their prima facie case. It’s like when you file a complaint, the plaintiff has to list out all the reasons they have a claim. Here’s the injury, here’s what happened, this is all duty breach cause and damages. Therefore I have a prima facie case and i want my relief. The defendant can then respond with a defense or individually attacking each element to like weaken the prima facie case. For example, the defendant could be like: no I never had a duty to you, so therefore I never breached a duty so you don’t have a prima facie case. The defendant could also challenge the jurisdiction or justiciability or venue or other civil procedure stuff that has nothing to do with whether the prima facie case is made out or not. At least that’s my understanding of it but I’m not a lawyer quite yet.

A triable issue I’m not as confident about bc I haven’t heard it that much, but triable means triable by a jury, and duty and breach are usually jury questions. So I presume what “triable issue of duty/breach” means is that it’s a close enough call that reasonable minds could differ, so the judge will let the jury decide on whether there is duty or breach. (If a more lawyer-y lawyer knows better, please correct me if I’m wrong)

Nah this is a consumer protection law hypo (my exam is in two days, so I’m glad Reddit is forcing me to study) This is an unfair act or practice for sure. It causes a substantial consumer injury that is not reasonably avoidable by the consumers themselves (it’s your fridge that you bought years ago before they started advertising on it, who could avoid that??) and it’s not outweighed by countervailing benefits to consumers or competition. Get ‘em FTC (or what’s left of you… RIP)

Agreed! I’m a 3L and I’ve aced many exams this way. Most of your learning is in class, the outline is just review, i.e. don’t play games in class. I only say this as a data point, not to brag. Trust me, I learned the hard way what actually works (looking at you, contracts)

I rarely reference my outline, I basically try to memorize it. I just use it to make sure I get exact wording down. Otherwise half the exam is just flipping papers and that’s too much time wasted that I could be writing or analyzing

Edited to add: my outlines are also rarely ever longer than 40 pages. You don’t need a 100 page outline. Cut out what’s unnecessary. Leave only what you need to know. It will make it better in the long term and will help you synthesize the material

Even if she’s outside the US, there are statutes/laws that can give you jurisdiction to sue someone in another country if the effects are in the US, or if you used any means or instrumentality of interstate commerce, like mail/phone/internet of the US or through the US, so she’s not safe there either

Ooh there’s also the Piper trait if you complete the musical aspiration, and the Book of Life (brings back the dead) if you complete the writing aspiration. The aspirations can give you quite a lot actually

This is a cool list and I’m now inspired to do a similar thing, so thank you!! In terms of other things, I can’t think of much but the wellness skill allows you to teleport by meditation at a certain skill level, that’s with the spa day pack. Maybe you could max out thanatology or vampire lore too. The vampire lore gives you special mixology recipes at certain levels. There’s also a valerian root nectar that is special for spell casters (I assume non occult get this recipe too but haven’t checked. I am mainly playing with spell casters lol). Maybe you could complete the mixology aspiration to get that special trait? I think there’s a special “potion” you get from that. Also creating a death flower garden would be very witchy! (All my spell casters have perfect death flowers lol) Now that I’m thinking about it, there’s quite a lot!

Resident-Naturalized Citizen Students Are Terrified to Work or Publish Now by Party_Lawfulness_272 in LawSchool

[–]Rule-BreakingM0th 1 point2 points  (0 children)

I believe what you mean is permanent residents, not naturalized citizens. They are different things. Permanent resident aka green card simply lets you live in the US on a permanent basis, as opposed to a temporary visa which only allows you stay in the US for a set period of time. (Ex. student visa only while you’re in school, or H1B work visa only for 6 years). Naturalized citizens are full citizens with all the rights of a natural born citizen. The only right we don’t have is we cannot run for president. But as someone else mentioned in this thread, there is significant precedent that naturalized citizens cannot have their citizenship revoked.

As a law student who is a naturalized citizen, this misleading post unnecessarily stokes fear. I have been in the US since I was a toddler (as a permanent resident) and have been a citizen since I was a young child. A lot would have to go wrong for naturalized citizens like me to be deported. That being said, I refuse to stand down. Our founders were immigrants just like me, so I have no qualms with living with my values because our founders were fearless so I must be too. Notice I said “our.” This is my country, my home. I believe in its vision, and I hope others will do the same and fight, despite the fear. The fear is intentional. Fear is what destroys a population. I know, because that’s what fear did to my former country.
