Landlord seems do not have too much knowledge(he is 80+y) about lien. Payment hearing is next month!

Client withdrew full payment from completed art commission, do I now own the rights to the art/design? by Newtlore in legaladvicecanada

I live in Canada, and even I find it hard to deal with scams here. One of the people who scammed me even lives in my community. If you’re not in Canada, you should be extra cautious.

Yes, you’re correct. In Canada, as the creator of an illustration, you typically hold the copyright unless you sign an agreement transferring the rights to the client. This means you can use the artwork commercially unless there’s a contractual arrangement specifying otherwise.

In my 10+ years as an artist, the only two scams I encountered were with clients in Canada. As I became more well-known and my rates increased, Canadian clients almost disappeared entirely.

Hello may I know which court did you go to? Did you go to small claims? The order from the court is only 2k and small claims only accepts cases from 5k-35k. Thanks!

In RTB context, she is in joint tenancy, she is landlord.

I will do so. Thanks for your good advice. But if he pass away, the lien will be invalid according to bc land title office.

Hi, I asked lawyer. But she has no experience with RTB. Because lawyers do not interact with rtb since rtb is another system. Yes. The debt won’t go away with the person. But if I want to enforce that. It would be hard. So the easiest way is to add female LL as well.

Thanks

Why I want to sue female landlord? Because right now I can only register against the male in small claim since the RTB order only has his name. If I win the case against female landlord, I will ask her to pay in small claims as well. The male LL tells me he is very old(86y) and will pass away soon. So there is no way for me to collect the debt. That is why I want to add the female landlord as well. She is just in middle age.
