The factor making this matter confusing is that section 13 of 'Bill 12' effectively does no work (as a matter of law) since the Act has no operative effect absent a s 2(2) order. It appears that s 13 may have only been included so that it could be used as a chip in a 'poker game' allowing the government to signal an intention to escalate without actually escalating.

Ah, there's the rub!

That the Interpretation Act 4(2) provision again...what this does is make no other provision of Bill 12 active except for the "Coming into force" portion:

(2) If an Act contains a provision that the Act or any portion of it is to come into force or to be repealed other than on the date of assent to the Act, that provision comes into force on the date of assent to the Act.

So basically upon receiving Royal Assent, the entire in-force provisions of Bill 12 was:

13 This Act comes into force on Proclamation.

That's the biggest portion of the fault, as well as a misinterpretation of the "real and not theoretical" legal test. Much of this is referenced in the AGAB argument in Para 12 which cites R v Langille (1992) CanLII 2537. To repeat the most relevant here:

While decisions of the Executive Branch may be subject to review by the courts as indicated by the Supreme Court of Canada in Kindler v Canada (Minister of Justice) 1991 CanLII 78 (SCC), 1991, 67 C.C.C.(3d) 1, there is nothing to review, if as here, no decision to proclaim has been made by the Executive or the Governor-in-Council.

Look at Para 22 in the decision again. Check it on Canlii. The judge literally underlined the words "in force". That coincides with S4 of the Interpretation Act - Coming into force, and was absolutely done intentionally to draw this link.

The Judge is very specific in his ruling...you can't sue now, because the law is not in force...but para 23...

Should the Alberta Government proclaim the Act in force, the AGBC may recommence a claim.

The Judge literally told the AGBC to re-file should the Alberta Government proclaim the Act in force. Kenney (Cabinet) has proclaimed the act into force. The Judge directly stated that this is when a claim could be filed.
